Reference is made to that certain real property situated in the City of Redwood City, <br /> County of San Mateo, State of California, known as the One Marina site and described on Exhibit "A", <br /> attached hereto and incorporated by this reference as if fully set forth herein (the "Property"). The <br /> Property is being developed as a condominium project. The Developer expects to transfer its interest in <br /> the Property to the One Marina Owner's Association ("HOA"), a California nonprofit mutual benefit <br /> corporation, which HOA shall be ultimately responsible for the management, operation and governance <br /> of the Property. <br /> B. In connection with its development of the Property as a residential community, the <br /> Developer submitted to the City a Precise Plan, PC Permit, and Construction Documents, which include, <br /> inter alia, landscaping plans for reconstructed Bair Island Road along the Property frontage ("Plans"), all <br /> of which Plans have been approved by the City. The Plans provide for installation of certain landscaping, <br /> pedestrian lighting, irrigation piping and controller, pedestrian path, and bicycle path ("Improvements") <br /> within that portion of the City owned right of way and easement area beginning at the back of the south <br /> Bair Island Road curb and extending south from there to the south side of the pedestrian path/sidewalk <br /> along the entire One Marina site frontage along Bair Island Road ("Maintenance Area") as the <br /> Improvements and Maintenance Area are more specifically shown on Exhibit"B"attached hereto and by <br /> this reference made a part hereof. <br /> C. Reference is made to the Landscape Maintenance Agreement for the Phase 1 Bair Island <br /> Road improvements,recorded in the Official Records of the County of San Mateo as document no. 2011- <br /> 115422. <br /> D.
