Section 4. Downtown Planned Community Permit DPC2013-06: The <br /> Planning Commission finds that: <br /> a. The project and improvements proposed by Planned <br /> Community Permit Application No. DPC2013-06 are consistent <br /> with, conform to the intent of, and will appropriately implement <br /> the Downtown Precise Plan for the 439 Fuller Street project; <br /> and <br /> b. The establishment, maintenance and operation of the project <br /> and improvements proposed by Planned Community Permit <br /> No. DPC2013-06 will not, under the circumstances of this <br /> particular case, be detrimental to the health, safety peace, <br /> morals, or general welfare of persons residing or working in the <br /> neighborhood of the project, or be detrimental or injurious to <br /> property or improvements in the neighborhood of the project, or <br /> to the general welfare of the City, because the project has been <br /> found to be consistent with the community goals established in <br /> the City's General Plan and Zoning Ordinance; and <br /> c. The Project and improvements comply fully with all applicable <br /> standards of the DTPP; and <br /> d. The Project and improvements comply with all but six <br /> guidelines of the DTPP. The aspects of the Project which do <br /> not conform to the guidelines of the DTPP nonetheless <br /> adequately promote the overall intent of the DTPP. <br /> Section 5. The Tentative Parcel Map and Planned Community Permit are <br /> hereby approved based on the Planning Commission's consideration and reliance on <br /> the Initial Study (IS) and Downtown Precise Plan DR and in accordance with the <br /> plans, details and descriptions contained therein, attached hereto and incorporated <br /> herein by reference, and subject to the following Conditions of Approval: <br /> CONDITIONS OF APPROVAL: <br /> 1. Applicant shall insure that all improvements substantially conform to <br /> the project plans, prepared by Christiani Johnson Architects, submitted on <br /> November 6, 2013 (dated November 1, 2013), the revised window detail submitted <br /> on January 27, 2014, and the revised ground floor detail submitted on February 10, <br /> 2014, and related information submitted by Applicant, on file with Planning Services. <br /> All modifications to said approved plans must be submitted to the Planning Division <br /> for review and approval prior to the issuance of a Building Permit. Substantial <br /> modification of said approved plans, as determined by the Community Development <br /> Director or his/her designee, may be subject to a new PC Permit per Section 2.0.3 of <br /> the Downtown Precise Plan. <br /> ATTY/RES0.2964/PC RHO APPROVAL OF TENTATIVE PARCEL MAP(439 FULLER ST( <br /> REV:03-13-14 VR <br /> Page 4 of 12 <br />
