7.4.A. - Page 4 ATTACHMENT 1 <br /> ORDINANCE NO. <br /> ORDINANCE OF THE CITY OF REDWOOD CITY ADDING A NEW <br /> CHAPTER 31 RELATING TO THE ESTABLISHMENT OF COMMUNITY <br /> BENEFIT IMPROVEMENT DISTRICTS AND ADOPTING BY <br /> REFERENCE PROVISIONS OF THE PROPERTY AND BUSINESS <br /> IMPROVEMENT LAW OF 1994 (CAL. STREETS & HIGHWAYS CODE <br /> §36600, ET SEQ.) <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br /> ORDAIN AS FOLLOWS: <br /> Section 1. The City Council makes the following findings: <br /> 1. Pursuant to Article XI, Section 5 of the California Constitution, the City may make <br /> and enforce all ordinances and regulations with respect to municipal affairs, <br /> subject only to restrictions and limitations provided in its charter; and <br /> 2. Section 3 of the City Charter provides that, except as prohibited by the state <br /> constitution or restricted by the City Charter, the City shall and may exercise all <br /> municipal powers, functions, rights, privileges and immunities of every name and <br /> nature whatsoever; and <br /> 3. The creation of an assessment district to fund improvements and services of a <br /> local nature is a quintessential municipal affair, and no specific statutory authority <br /> is required for the creation of such an assessment district by a charter city; and <br /> 4. Section 74 of the City Charter authorizes the City to make improvements and <br /> levy assessments in conformity with and under the authority conferred by the <br /> general laws of the State, but does not preempt the adoption of a local <br /> procedural ordinance unless that ordinance prevents or limits the Council from <br /> proceeding under any of the general laws of the State; and <br /> 5. Although the Property and Business Improvement District Law of 1994 (Streets & <br /> Highways Code §§ 36600 et seq.), provides a procedure for the establishment of <br /> a business improvement district and the levy of an assessment against real <br /> ATTY/ORD.400/CBID PROCEDURE ORDINANCE <br /> REV:03-18-14 PT <br /> Page 1 of 7 <br />
