7.5.A. - Page 4 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY OF REDWOOD CITY ADDING A <br /> NEW ARTICLE V TO CHAPTER 2 (ADMINISTRATION) <br /> RELATING TO ACQUISITION AND DISPOSITION OF REAL <br /> PROPERTY <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES ORDAIN AS FOLLOWS: <br /> Section 1. The City Council hereby makes the following findings: <br /> 1. Redwood City Charter Section 3 1/2 provides in part that the City Council may <br /> control and dispose of real property for the "common benefit" and further that <br /> the City Council may enact additional provisions by ordinance relating to this <br /> Section. <br /> 2. In addition, state law includes a number of statutes that potentially govern the <br /> disposition of surplus City land, including Government Code § 54220, et seq. <br /> ("Surplus Land Act"). Under the Surplus Land Act, state agencies and <br /> subdivisions of the state, including cities or counties, disposing of surplus land <br /> must first send a written offer to sell and negotiate in good faith the <br /> conveyance of such surplus land with certain local agencies designated by <br /> the state for affordable housing, recreation, open space and school purposes. <br /> Any conveyances of surplus land under this Article would be subject to the <br /> state Surplus Land Act. <br /> 3. Under state law, "surplus land" means "land owned by any local agency that <br /> is determined to be no longer necessary for the agency's use, except property <br /> held by the agency for the purpose of exchange."
