8.A. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> March 24, 2014 <br /> SUBJECT <br /> Appeal of Planning Commission's Approval of a Planned Development Permit including <br /> Parking Modifications, Vesting Tentative Map and Condominium Permit approved by <br /> the Planning Commission for the Pete's Harbor Project, located at 1 Uccelli Boulevard <br /> RECOMMENDATION <br /> Hold a Public Hearing and Adopt a Resolution (Attachment 1) Denying the Appeal and <br /> approving the Planned Development (PD) Permit including Parking Modifications, <br /> Vesting Tentative Map and Condominium Permit based on the findings and subject to <br /> the conditions of approval contained therein upon consideration of Revised Addendum <br /> No. 2 (dated February 2014) to the 2003 certified Marina Shores Village Environmental <br /> Impact Report (2003 EIR). <br /> I. INTRODUCTION AND SUMMARY <br /> RWC Harbor Communities, LLC (Applicant) seeks to redevelop approximately 14 acres <br /> at property commonly known as Pete's Harbor. It proposes 411 multi-family residential <br /> units and associated parking, a clubhouse, a community pool, walkways, and public <br /> open space areas along Smith Slough, among other components (the Project). The <br /> Project is a scaled down version of a 2003 proposal to redevelop Pete's Harbor. <br /> In July 2012, RWC Harbor Communities applied for a Planned Development (PD) <br /> Permit and Vesting Tentative Map. The City (1) updated the environmental review <br /> pursuant to the California Environmental Quality Act (CEQA) by preparing an <br /> Addendum (2012) to the 2003 Environmental Impact Report (EIR) and (2) analyzed the <br /> Application pursuant to the City's General Plan and Zoning Code. In October 2012, the <br /> Planning Commission considered the CEQA analysis, including the 2012 Addendum to <br /> the EIR (Addendum No. 2), and the merits of the Project. The Planning Commission <br /> approved Addendum No. 2 and the Application. <br /> The "Save Pete's Harbor 2012" association filed an appeal of the Planning Commission <br /> approvals to the City Council in November 2012 (2012 Appeal). Meanwhile, the <br /> Applicant was working with the State Lands Commission (SLC) and the Bay <br /> Conservation and Development District (BCDC) regarding lease amendments for <br /> portions of the marina and regulatory approvals. During this process, the Applicant <br /> prepared modifications and clarifications to the Project that addressed issues raised by <br /> SLC, BCDC and Save Pete's Harbor 2012.
