Should the Council have an <br /> interest in accommodating this request, staff believes that the condition can be <br /> amended to allow more flexibility but maintain the commitment that all approvals be <br /> obtained for the Project to proceed, as revised below for consideration: <br /> 6. The Applicant shall comply with any and all Federal regulatory or state agency <br /> requirements and obtain any and all necessary Federal regulatory or state <br /> agency approvals required for development of the Project other than the inner <br /> marina prior to commencement of construction. In addition, prior to the <br /> issuance of a Certificate of Occupancy for any residential unit, the Applicant <br /> shall obtain any and all Federal regulatory or state agency permits or approvals <br /> for the reconfiguration of the inner marina ("Other Marina Approvals"). The <br /> current configuration of the inner marina may not be removed or modified until <br /> and unless the Applicant has obtained all Other Marina Approvals for the new <br /> configuration of the inner marina. <br /> FISCAL IMPACT <br /> None anticipated. Review of the proposed project is subject to the City's Cost Recovery <br /> System; therefore, direct costs during the entitlement process associated with staff's <br /> time and materials are covered by an applicant deposit. Should the Project be <br /> approved, the Applicant will be required to pay development impact fees, as applicable <br /> and as established by ordinance. <br /> ENVIRONMENTAL REVIEW <br /> The environmental impacts associated with the proposed Pete's Harbor project have <br /> been analyzed in the Marina Shores Village Environmental Impact Report, (including <br /> Addenda No's 1 and 2), as previously described in this report. Section 2 of the 2014 <br /> Revised Addendum No. 2 (Attachment 9) describes the specific differences between the <br /> current Pete's Harbor Project and the 2003 EIR project. Section 3 of Revised <br /> Addendum No. 2 describes how the differences between the current Pete's Harbor <br /> project and the 2003 EIR project affect the impact and mitigation conclusions of the <br /> 2003 EIR.
