("SF Bay MFA") is a California public benefit <br /> 16 <br /> nonprofit, with a mission to preserve marinas in and around San Francisco Bay and to protect <br /> 17 <br /> broad public access to such marinas. Our group desires to encourage a Bay-wide renaissance <br /> 18 <br /> 19 of the building of independently-owned marinas open to recreational and commercial uses <br /> 20 of all kinds— including the permitted number of residential liveaboards that can coexist in a <br /> 21 commercial marina, which is all now permitted by, and consistent with, applicable law. <br /> 22 <br /> Such applicable laws supporting mixed use include the Public Resources Code, the <br /> 23 <br /> Public Trust doctrine, the Floating Home Residency Law, the Bay Plan under the McAteer-Petris <br /> 24 <br /> 25 Act(forming the BCDC, and permitting up to 10% of slips in all marinas for liveaboards), and <br /> 26 most salient and applicable to this location, the 1983 Act of the Legislature declaring mixed-use <br /> 27 commercial/recreational/residential "consistent with the Public Trust", <br /> 28 <br /> Appeal of Planning Commission Issuance of PD Permit, Vesting Map and Condo <br /> Permit - 1 Uccelli Boulevard, Redwood City <br />
