7.1.C. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> March 24, 2014 <br /> SUBJECT <br /> Amendment No. 3 to Extend the Agreement with David J. Powers & Associates, Inc. for <br /> Professional Services for the Cambridge Academy Project <br /> RECOMMENDATION <br /> By motion, approve and authorize the City Manager to execute Amendment No. 3 to <br /> Extend the Agreement with David J. Powers & Associates in the amount of $4,659.00 to <br /> complete work related to the Cambridge Academy appeal. <br /> BACKGROUND <br /> On May 31, 2012, the City executed an agreement with David J. Powers & Associates <br /> in the amount of $10,965.00 to assist staff with the preparation of preliminary <br /> environmental analyses for the Cambridge Academy project. The Cambridge Academy <br /> project proposes to operate a transitional kindergarten through 8th grade private school <br /> at the Redwood Baptist Church property located at 2323 Euclid Avenue. On May 17, <br /> 2013, the City executed Amendment No. 1 to extend professional services in the <br /> amount of $42,260.00 to assist staff with the preparation of an Environmental Impact <br /> Report (EIR). During the 45-day public comment period on the Draft EIR, the City <br /> received more comment letters than initially estimated. On January 21, 2014, the City <br /> executed Amendment No. 2 in the amount of $4,890.00 to extend professional services <br /> to assist staff in preparing responses to written comments on the Draft EIR. <br /> ANALYSIS <br /> On February 18, 2014, an appeal was filed on the Planning Commission's decision on <br /> the Cambridge Academy project. To assist staff with the review of the appeal and <br /> prepare for the appeal hearing, David J. Powers & Associates is requesting a budget <br /> amendment in the amount of $4,659, for a total contract amount of $62,774. The scope <br /> of work under this amendment would require the consultant to complete the following <br /> tasks: <br /> • Evaluate and prepare a written response to the appeal. <br /> • In accordance with CEQA Guidelines and the City's requirements, evaluate the <br /> proposed changes to the project and determine whether the project modifications <br /> would result in new or more severe impacts than previously disclosed in the <br /> Environmental Impact Report prepared for the project. <br /> • Attend the appeal hearing. <br />
