Conclusion. Slightly modified mitigation. The references to CDFG have been changed to CDFW. The mitigation identified in the 2003 EIR for Impact 8-4 as modified remains applicable to the current Pete's Harbor project and remains sufficient to reduce this impact to a less-than- significant level. As stated in the mitigation, if the required breeding surveys (subject to USFWS and CDFW approval) conclude to jurisdictional agency satisfaction that the distance of any identified special-status species territory from project construction activity represents a suitable buffer, no further action regarding the identified species would be required. Impact 8-5 Analysis: Project-Related Loss of Estuarine Navigable Waters and Other Waters of the U.S. The certified 2003 EIR indicated that the project would fill approximately 11.54 acres of waters under the jurisdiction of the Army Corps of Engineers (Corps) (also see Impact 8-1). The associated 2003 EIR mitigation described a series of related jurisdictional agency approvals that the applicant must therefore obtain, including: (1) Section 10 and 404 permits from the Corps, (2) a Section 401 certification or waiver from the Regional Water Quality Control Board (RWQCB), (3) a 1603 Streambed Alteration Agreement from the CDFG, and (4) an HMMP (as described under other 2003 EIR mitigations--see above). The current Pete's Harbor project would not fill any waters under Corps jurisdiction. Conclusion. Mitigation 8-5 is no longer required. The currently proposed Pete's Harbor project would not fill any navigable waters or other waters of the United States, and this impact would not occur. Impact 8-6 Analysis: Project Loss of Saline Emergent Wetlands. The certified 2003 EIR concluded that the Marina Shores Village project might fill an unspecified amount of existing saline emergent wetlands along the shorelines of Redwood Creek, Smith Slough, and the marinas. The associated 2003 EIR mitigation was similar to that for Impact 8-5 above, requiring various approvals by jurisdictional agencies (i.e., Corps, RWQCB, San Francisco Bay Conservation and Development Commission--BCDC), including associated HMMP provisions. The current Pete's Harbor project would modify, but not fill, saline emergent wetlands along the perimeter of the proposed reconfigured inner marina. The reconfigured marina would occupy the same 3.18-acre footprint as the existing marina. In comparison, the 2003 project would have resulted in the loss of saline emergent wetlands along much of the larger project's perimeter. Impact 8-6, therefore, would be greatly reduced compared to the 2003 project. Conclusion. Modified Impact and Mitigation 8-6. The references to "fill" wetlands have been replaced with "modify" wetlands. A cross-reference to Mitigation 9-3 (Temporary Impacts from Proposed Inner Marina Reconfiguration) has been added, and the references to CDFG have been changed to CDFW. The mitigation as modified remains applicable to the current Pete's Harbor project and remains sufficient to reduce the impact to a less-than-significant level. Impact 8-7 Analysis: Project-Related Loss of Fresh Emergent Wetlands. Similar to Impact 8-6, the certified 2003 EIR concluded that the Marina Shores Village project might also fill an unspecified amount of fresh emergent wetlands, which are located in patches entirely in the southwest corner of the Peninsula Marina property, at the intersection of Bair Island Road and T.110695 Pete's Harbor EIR Addendumlrevised addendum no 213(10695-01).doc
