Fish &Wildlife Service <br /> 1 Marshlands Road <br /> Fremont, CA 94555 <br /> Dear Ms. Morkill: <br /> Re: Easement <br /> As we have discussed previously, our entity, RWC Harbor Communities, LLC (RHC), has <br /> applied for a City of Redwood City Planned Development Permit for a residential <br /> community at a property known as Pete's Harbor located at One Uccelli Boulevard in <br /> Redwood City. <br /> RHC is under contract to purchase the Pete's Harbor property for the aforementioned <br /> development of the residential community. <br /> Background Regarding Easement <br /> On February 17, 1965, Leslie Salt Co. granted an easement deed (see Exhibit"A" to this <br /> letter) to Peter Uccelli, Jr. (Uccelli) across the property described in Exhibit"A". The <br /> purpose of the easement was for, ".....ingress and egress from adjoining real property of <br /> Uccelli." Leslie Salt Co. subsequently transferred its ownership interest in the Exhibit"A" <br /> property to Peninsula Open Space Trust who subsequently transferred its ownership to <br /> U.S. Fish and Wildlife Service. The aforementioned easement in Paragraph 4 states that it <br /> is binding upon the successors and assigns of the parties. <br /> For the past 48 years Uccelli and his successors and assigns, have used the aforementioned <br /> easement for vehicular and pedestrian ingress and egress to the Uccelli/Pete's Harbor <br /> property. <br /> Planned Use of Easement <br /> As you will see from the attached Exhibit "B" which is a site plan of the proposed <br /> residential development at Pete's Harbor, RHC intends to continue the use of the <br /> 650 Bair Island Road,Redwood City,CA 94063 • 650-365-7400 • Fax:650-369-1317 <br />
