U . S . Arm y Corp of Cor Engineers - Letter of Permission <br /> To avoid take of steelhead,green sturgeon,longfin smelt,and California least tern,the following <br /> avoidance and minimization measures will be implemented by the Project: <br /> • All pile driving and dock installation work would be undertaken after June 15 and <br /> completed no later than November 30, to adhere to the south San Francisco Bay <br /> steelhead environmental work window, <br /> • Construction vessels will not come to rest on bay substrate during low tide periods; <br /> • If it is necessary to use an impact hammer.(a)any number and any size of wooden piles <br /> may be driven at between June 15 and November 30;(b)Concrete piles may be driven <br /> at any time of year as long as the pile diameter is less than 18 in;(c)steel piles may be <br /> installed at any lime of year as long as the piles are 12 in or less in diameter,the impact <br /> hammer is 3,000 pounds or smaller, and a wood cushion is used between the hammer <br /> and the pile; (d)use of an impact hammer is limited to one hammer and less than 50 <br /> piles installed per day. <br /> • if wood piles are used, wood material must be coated with an impact resistant, <br /> biologically inert substance,as described in the NLAA1 consultation; <br /> • if steel or concrete piles are used,any coating applied to the piles will be done outside of <br /> the work area and allowed time to fully cure prior to installation; <br /> • if in-place pouring of concrete is necessary, localized cofferdams will be used <br /> surrounding pilings or footings during repair; <br /> • Any repair of shallow water piles would need to be performed manually at low tide or <br /> using a vessel that would not rest on the bottom during low tide; <br /> • During construction activities, a debris barrier will be installed to retain any debris that <br /> falls into the water; <br /> • All preparation of dock and pier materials will be done on shore or in a designated area <br /> on the construction barge. If it is not possible to prepare all material on shore or on the <br /> construction barge,a tarp or netting could be installed in a designated work area on the <br /> pier; <br /> • Wooden deck material, if used, for the floating dock must be coated with an impact <br /> resistant,biologically inert substance,as described in the NLAA consultation; <br /> • Floatation devices(such as used on a floating dock)must be composed of materials that <br /> will not disintegrate, such as plastic or closed cell foam encapsulated in sun-resistant <br /> polyethylene, as described in the NLAA consultation; Contractor will follow the Water <br /> Quality Protection Plan,which contains BMPs and other measures to prevent hazardous <br /> materials from entering the waters of San Francisco Bay; <br /> • Contractor would have spill prevention and containment equipment during project <br /> construction. • <br /> These measures are incorporated into the Project Description to avoid and minimize potential • <br /> impacts to special-status species and other aquatic resources. Many of these measures are • <br /> based on the NLAA consultation,which was developed to avoid and minimize potential impacts <br /> to aquatic resources to a level that would not adversely affect aquatic species.
