7.1.G. - Page 62 (a) Building(s): Building 15, as shown on the Current Phase Condominium Plan and defined in the Declaration; (b) Building Common Area: The designated Building Common Area for Building 15, as shown on the Current Phase Condominium Plan and defined in the Declaration; (c) Units: Units 1501 through 1503 and Units 1505 through 1508, all located in Building 15 as shown on the Current Phase Condominium Plan and defined in the Declaration; (d) Association Common Area: Subject to subsection 2(e) below, the Association Common Area as shown on the Current Phase Condominium Plan and defined in the Declaration; as such Building, Building Common Area, Units and Association Common Area are shown and described on the Current Phase Condominium Plan, are hereby annexed to and made a part of the Development described in the Declaration. Upon the conveyance of title to a Condominium in the annexed property or the commencement of assessments for Condominiums in the annexed property, whichever occurs first, the annexed property shall be held, sold, leased, transferred, occupied, and conveyed subject to the terms, provisions, covenants, conditions, restrictions, and easements of the Declaration and its amendments as if the annexed property were originally subject to the Declaration. (e) Notwithstanding the foregoing, certain portions of the Association Common Area shall be temporarily retained by Declarant and transferred to the Association in connection with a future Phase of the Development, as described in Section 6 of this Declaration of Annexation, and as further described in the "Declaration of Reciprocal Access Easement and Use and Maintenance Agreement (Association Common Area)," which was recorded on January 13, 2012, as Instrument No. 2012-005181 in the Official Records (the "REA"), and any amendments,modifications or supplements thereto. 3. Interests. The owner of a Condominium will receive a separate interest in a Unit and an equal undivided percentage interest in common in the Building Common Area of the Condominium Building in which that Unit is located, as described in the Declaration. The percentage interest and percentage share of total Assessments shall be as described in the Declaration. 4. Association Membership. Upon commencement of Assessments for the Condominium Units in Phase 11, each Unit shall include a membership in One Marina Owners Association, which membership is appurtenant to the member's Condominium. Each Owner shall be entitled to participation in the affairs of the Association as provided in the Declaration and Bylaws. 5. Conveyance of Common Area. (a) Declarant shall convey the portion of the Association Common Area shown as Association Common Area 2 ("ACA 2") on the Current Phase Condominium Plan to the Association prior to the close of escrow for the sale of the first Condominium in Phase 11, to be held for the benefit of all Members of the Association. 3 6557.02/Declaration of Annexation.One Marina PHASE 11(DRAFT 1-24-14)
