7.1.C. - Page 6
8. PUBLIC HEARING(S)
A. Appeal of Planning Commission's Approval of a Planned Development
Permit including Parking Modifications, Vesting Tentative Map and
Condominium Permit approved by the Planning Commission for the
Pete's Harbor Project, located at 1 Uccelli Boulevard
Mayor Gee set the ground rules for the public hearing and how he asked for respect of
divergent views and focus on the subject matter at hand.
Bill Ekern, Community Development Director, provided the staff report (presentation on
file). He covered the key elements of the project and noted that the acreage has
changed and so the project has 402 units due to a recalculation of the project because
of the land area but the number of parking spaces remains the same. He reviewed the
revised project density and noted that the resolution has been updated to show the
eight items he explained in detail.
Mr. Ekern then addressed and provided individual responses to the eight points on the
appeal. He spoke about Condition #6 which has been added to the record and he said
that basically all the permits need to be in before the development of the marina can
take place. He further noted that it is a right to have a marina but not an obligation.
Mayor Gee then introduced one of the appellants Ms. Tania Sole. Ms. Sole spoke
under protest because Ms. Madden, the other appellant, is in the hospital and Ms. Sole
reminded the city that it had requested a change in the process and Ms. Madden
agreed to the change in the date. She commented that the City also did not agree to
the bifurcation of the items tonight and said the city may be at risk for dispute. She
made various allegations about the land and the area. She said the federal strip
acreage should be removed from the development and that that Planning Commission
should redraw the permits. She also spoke about traffic issues, a water trail destination,
water quality issues, short notice for the appeal, attorney fees for the BCDC (San
Francisco Bay Conservation and Development Commission), civil rights, the live-
aboards, a BCDC permit needed for public access, and the General Plan, and she
asked Council to consider the implications of rushing forward given the possible legal
issues.
Paul Powers, the applicant, reviewed the attributes of the project (presentation on file)
and said he feels he followed BCDC's (San Francisco Bay Conservation and
Development Commission's) requests. He said the public access issue will be
discussed with BCDC once the City approves the project and noted that both BCDC
and the community has urged him to have a hand-launch boat area that is ADA
(American Disabilities Act) compliant. He spoke about working with BCDC to meet
certain guidelines including public access that will withstand a 35-inch sea level rise.
He spoke about public improvements, environmental benefits, how most of Pete's
Harbor has buildings and open space, economic benefits, and he also noted that the
project complies with the Zoning and the General Plan.
CITY COUNCIL March 24, 2014
MEETING MINUTES PAGE 6
