He spoke in favor of denying <br /> the appeal and moving forward. <br /> Vincent Pao, representing Aqua Sports, spoke in favor of denying the appeal and t <br /> move the project forward. He spoke about donating a cart to move the items to the <br /> hand launch boat ramp. <br /> Maria Messina spoke in favor of the project moving forward and said the increase in <br /> property taxes would benefit children and the schools. <br /> M/S Foust/Aguirre to close the Public Hearing. Motion carried unanimously 7-0 <br /> by voice vote. <br /> Council discussion <br /> One Council Member inquired if the appeal was expedited and Ms. Thompson, City <br /> Attorney, said it followed the usual city guidelines of 90 days. Then, this Council <br /> Member inquired if CEQA (California Environmental Quality Act) has a shelf life for EIRs <br /> (Environmental Impact Report). Staff said it does not. This Council Member inquired if <br /> the City has guidelines on sea level rise and Mr. Ekern said that it does not but is <br /> looking at BCDC's (San Francisco Bay Conservation and Development Commission) <br /> guidelines. In terms of parking and emergency access, he inquired if this is an issue <br /> and Mr. Ekern acknowledged this and said it has already been addressed and he added <br /> that fire safety has been improved. Dr. Bell, City Manager, added that the city has a fire <br /> boat with Fire Suppression personnel and new equipment and we are more qualified to <br /> address emergencies. <br /> Another Council Member inquired about the deed, more specifically if the width of the <br /> easement right-of-way is adequate for the road, and the traffic that will be generated. <br /> Mr. Ekern said that the width of the easement is wide enough to provide a road. She <br /> also inquired about the water supply not being adequate and Mr. Ekern said that any <br /> project has to identify a source of water. The traffic was also addressed and she said <br /> that the developer has been working with the Alliance and is looking at shuttles, ride <br /> shares, water taxies, and ferry service. She also inquired about the Blomquist <br /> extension and Mr. Ekern said staff is trying to figure out the alignment. This Council <br /> Member inquired about the added outreach and how it went. Mr. Powers said the three <br /> meetings went well. <br /> A Council Member is pleased that many places in the project will be raised to 36 inches. <br /> Mr. Ekern confirmed that the developer bears the cost for this and any sea walls so that <br /> it will not be a tax payer issue. Mr. Ekern confirmed this and noted that the road would <br /> be raised to meet the BCDC requirement for public access and to meet flooding <br /> conditions. This Council Member asked Mr. Powers about the status of phasing in <br /> terms of the marina on the General Plan, for both the current project and One Marina. <br /> Mr. Powers said that the permit they applied for two years ago was granted this last <br /> January by the U.S. Army Corp of Engineers and their construction time is restricted to <br /> protect wildlife but that they have already purchased the ADA ramp for it and are <br /> moving full steam ahead.
