4.2 Insurance. . . . For the purposes of this Tnsua•ance section,ENTITY is defined as the entity designing and/or performing the work funded by this ag,�•eement. ENTITY xnay be the Sl'ONSOR, a contractor of SPONSOR, another body on belialf af which SPONSOR submitted its grant application,or a contractor of such other body. If EN'I'ITY is not the SPONSOR,SPONSOR shall xequire by contract that ENTITY will provide the appropi7ate insurance for the work beingperfoimed. The insurance requirements speci�ed in this section sha11 coverENTTTY's own liability and any liability arising out of work or services of ENTITY's subcontractors, subconsultants,suppliers,temporary workers,independent contractors,leased employees,or any other persons, fu7ns or corporations(Iiereinafter collectively refeix�ed to as"Agents"} working on the Project. � a.Minimum TXpes and Scope of Insurance: � � ENTITY is required to procure and maintain at its sole cost and expense insurance subject to the requirements set forth below, Such insurance shall remain in full force and effect thraughout the term of the work. ENTITY is also requu ed to assess the rislcs associated with work to be perfor�ned by Agen#s and to require that Agents maintain adequate insurance � � coverages with appropria#e limits and endorsemen�s to cove�•such risks. To the extent that any Agent does not procure and maintain such insurarice coverage, ENTITY shall be responsible for and assume any and all costs and expenses that may be incurred in securing said coverage or in fulfilling ENTITY's indemnity obligations as to itself or any of its�Agents ' in the absence of coverage. SPONSOR and/or ENTITY may self insure against the risks associated with the Project, but in such case, shall waive subrogation in favor of the TA respecting any and all claims that rnay arise. � i. Workers' Compensation aiid&nplover's Liabilitv Insurance: Workers Compensation within Statutory Limits. Employer's Liability coverage with minimuun lim.its of$1 million. Insurance shall in.clude a waiver of subrogation in favor of the TA. . ii. Conunercial General Liability Insurance: The limit for Commercial�General Liability Insurance in each contract and subcontract shall not be less thari $10 million. • Cominercial General Liability Insurance shall be primaiy to any other insurance,naine the TA as an Additionai Insured, include a Separation of Interests endorsement and include a Vt�aiver of Subrogation in favor of the TA. iii. Business Automobile Liabilitv Insurance: The limit for Business Autom.obile Liability � Insurance in each contract and subcontract shall not be Iess than$10 million.
