<br />6. PUBLIC HEARINGS <br /> A. Public Hearing on Use Pennit Revocation Proceedings, Woodside Gas Mart, 895 Woodside <br /> Road, Redwood City. (604) <br /> Mayor Hartnett announced he had a client who owned property near 895 Woodside Road <br /> and to avoid any possible conflict of interest he would remove himself from discussion and <br /> voting on this matter. Mayor Hartnett left the dais and the Supervisors's Chamber at this <br /> time. Vice Mayor Howard became Mayor Pro Temfor this Council Agenda Item. <br /> MEMO 11/5/96 <br /> In response to questions from Mayor Pro Tem Howard, City Clerk Jorgenson advised that <br /> affidavits of publication and mailing of Notice of Public Hearing were on file in the City <br /> Clerk Department; <br /> At this time everyone who intended to give testimony before the Council stood, raised their <br /> right hands and answered affirmatively to the oath administered by the City Clerk. <br /> MEMO 11/5/96 <br /> 1. Staff report; <br /> REPORT: Planning Director Jany, November 4, 1996 <br /> Planning Director Jany provided background on the gas station/mini-mart at 895 <br /> Woodside Road. He said that San Mateo County Environmental Health records show <br /> that the station closed down two years ago in order to clean up soil and water <br /> contamination. In cases like these, the City allows businesses to re-open without any <br /> new pennits, as long as they operate as they had immediately prior to closure and <br /> remediation. <br /> Director Jany said that service stations have been continuously regulated by Article <br /> 35 of the Zoning Ordinance since the 1970's which means their development, <br /> maintenance and operation are under the purview of the Use Pennit process. Article <br /> 35 also includes requirements on improvements and operating standards. He explained <br /> that the Gas Mart at 895 Woodside Road was a non-confonning use primarily because <br /> it contains about half the area that is required by the Zoning Ordinance. <br /> Director Jany said the operations of the Gas Mart came under City scrutiny as a <br /> response to complaints from neighbors in the area regarding noise, glare from the <br /> lighting, new 24-hour operation, and traffic problems.
