<br />Morgan said 2600 people signed petitions and cards in support of the current <br />operation of the Gas Mart at 895 Woodside Road. <br />Mr. Morgan said his clients were willing to do the following: <br />1) "Fix or replace the fence so that the fence will conform with Mr. Jany's <br />requirements;" <br />2) "Add to the landscaping so that the landscaping will satisfy the City's <br />requirements;" <br />3) "Continue to operate the gas station between the hours of 6 a.m. and II p.m.;" <br />4) "Not willing to change the signs because the signs in fact are installed pursuant <br />to a sign pennit that was issued, no signs were added at the time remediation <br />was done. These signs are legal signs." <br />5) "Lighting at the facility is in fact a safety feature." Mr. Morgan referred to <br />photographs that would be shown later illustrating the lighting at 895 <br />Woodside was less onerous than at other stations along Woodside Road and an <br />apartment house across the street. <br />6) Mr. Morgan asked that as part of this trade-off the Gas Mart be allowed to <br />maintain the new 3'd island. He advised that the owners/operators would be <br />willing to meet with City staff to work out ways to mitigate problems, such as <br />changing directional flow patterns. <br />Mr. Morgan said all gas stations have the same impacts of a certain amount of <br />noise, bright lighting and traffic that can bother neighbors, but the <br />owners/operators had been amenable to changing fuel delivery times when asked to <br />by the neighbors. He said the above recommendations by his clients was a "good <br />faith effort to try and resolve this issue short of litigation." <br />Mr. Wayne Paynter, 847 South San Francisco, Attorney-at-Law representing <br />Sabek Inc., showed the Council photographs of other gas stations on Woodside <br />Road and the illumination of the apartment house across Woodside Road from the <br />Sabek, Inc. Gas Mart. He stated the light at 895 Woodside Road was restricted to <br />the area used by patrons and did not go past the property line. Mr. Paynter said <br />"The significance of the lighting is, it's all relative." <br />Mayor Pro Tem Howard advised that this meeting was to consider operations at <br />895 Woodside Road only.
