No prior drafts of this Agreement or changes from those drafts to the executed version of the Agreement shall be introduced as evidence in any litigation or other dispute resolution proceeding by any party or other person, and no court or other body should consider those drafts in interpreting this Agreement. 4. Each party covenants, on behalf of itself and its successors and assigns, to take all actions and to do all things, and to execute, with acknowledgment or affidavit if required, any writings that may be reasonably necessary or proper to achieve the purposes and objectives of this Agreement. 5. All of the provisions, agreements, rights, powers, standards, terms, waivers, covenants, and obligations contained in this Agreement shall be binding upon the parties and their respective successors in interest, whether by operation of law or any manner whatsoever, and shall inure to the benefit of the parties and their respective successors in interest. 6. This Agreement, and the rights and obligations of the parties, shall be governed by and interpreted in accordance with the laws of the State of California, as applied to contracts made and performed in this state. 7. The parties agree all amendments to this Agreement shall be in writing and executed in the same manner as this Agreement. Unless otherwise provided for in the amendment, such changes that are mutually agreed upon in writing by the parties shall be effective upon the execution of a duly authorized amendment to this Agreement. 8.
