Therefore, salvage materials and equipment shall not be stored <br /> outdoors in open view on the Property. <br /> 38. The Owner removed fencing and removed or pruned trees and other <br /> vegetation which had been installed and maintained on the Property prior to the <br /> closure thereof for the soils/groundwater contamination remediation. <br /> 39. Zon. Ord. Section 35.7 provides: <br /> "a. Materials, textures, colors, and designs of fences, walls, <br /> and screening shall be compatible with the on-site development [of <br /> service stations], the adjacent properties, and the neighborhood. <br /> Fences or walls shall be solid and constructed of materials such as <br /> masonry or wood and masonry, when used in connection with a <br /> service station adjacent to residential development and shall be 6 <br /> feet in height. Fences, walls, or screening within the first 20 feet of <br /> the street right-of-way line shall not be over 3 feet in height. <br /> b. All service stations existing upon the effective date of this <br /> section which do not meet the minimum provision for fences, walls, <br /> or screening as provided for herein, shall comply with the <br /> - provisions hereof within three years of the effective date of this <br /> section." <br /> 40. The service station use of the Property was in existence upon the <br /> effective date of the aforesaid section, and more than three years have elapsed <br /> since said effective date. The provisions of said section apply to use of the <br /> Property. Therefore, fences and screening on the Property shall conform to the <br /> provisions thereof. <br /> 41. Zon. Ord. Section 35.6 provides: <br /> "a. A detailed landscape plan shall be submitted in <br /> connection with an application for a use permit for every .new <br /> service station showing the location, size, and species of all <br /> proposed plant materials. <br /> b. Landscaped areas shall be established on all service <br /> station sites. Landscaping shall comprise a minimum of 10 percent <br /> of the net site area, defined as that site area excluding the area <br /> covered by structures and gasoline pumps. In certain areas of <br /> higher land uses or smaller lot sizes a lesser percent may be <br /> - approved by the Zoning Administrator if the Zoning Administrator <br /> MINUTE BOOK NO. 55 <br /> Page No. 039 <br /> Fndgs-3 <br />
