G. City and Developer desire to enter an agreement providing for the construction and <br /> installation of the Improvements in accorda.nce with the Improvement Plans. <br /> AGREEMENT <br /> NOW,THEREFORE,in consideration of the faithful performance of the terms and conditions set <br /> forth in ttus Ageement,the parties hereto agree as follows: <br /> 1. ��,,e. The purpose of this Agreement is to guarantee completion of the Improvements <br /> �nd ensure satisfactory performance by Developer of Developer's oblig�tions to satisfy the Conc�itions <br /> pertaining to the Improvements. <br /> 2. Propertv Subject to Agreement. The Property shall be suhject to tlus Agreement. <br /> 3. Dutv to Inst�ll Improvements. Develaper will construct,install and complete,or cause to <br /> be constructed, installed and completed, at the Developer's sole cost�nd expense, the Improvements, in <br /> accordance with the Improvement Plans (defined in Recital E. above) and to the s�tisfaction of the City <br /> Engineer, in his reasanable discretion. Developer will�lso supply all labor and materials therefor,alt in <br /> strict accordance with the terms and conditioris of this Agreement. The Improvements ahall include,but <br /> are not necessarily limited to,all of the following: <br /> (a) grading,paving <br /> (b) curbs,gutters,concrete walkways,driveways <br /> (c) sanitary sewer system,complete <br /> (d) permeable pavers <br /> (e) water system,complete <br /> (fl storm drainage system,ccxnplete <br /> (g) site lighting system,complete <br /> (h) street trees <br /> (i) landscaping and irrigation system complete <br /> (j) utility joint trenching <br /> (k) all conditions of approval for Tentative Subdivision Map entitled"Vesting Tentative <br /> Map,Qt�e Marina Lot 3C.3D.3E.�nnd 3F,"heretofore issued for said subdivision, <br /> (1) and sll other work, improvements, or construction required by or mentioned in the <br /> abovementioned plans and specifications,conditions of pernuts and all construction, <br /> �ppurtenances and improvements necessary as re�.sonable determined by the City <br /> Engineer to complete the aforementioned improvements, both within nnd outside of <br /> the abovementioned subdivision. <br /> The construction, installation and completion of the Improvements and all labor and materials furnished <br /> in connection therewith are hereinafter referred to collectively as the "Worlc."
