Entire Aqreement. Neither this Agreemen# nor any of its p�ovisians may <br /> be amended, modified, waived or discharged except in a writing signed by both parties. <br /> 18. Sev�rabilfty. The provisions of this Agreement shall be severable and ifi any <br /> phrase, clause, section� subsection, paragraph, subdivis�n, sentence or pro�ision is <br /> adjudged invalid or unconstitutional by a court of competent jurtsdic�on, or the <br /> applicab'tlity to any Property Owner is held invalid, this shall not affect or invalidete the <br /> remainder of any phrase, clause, section, subsection, paragraph, subdivision, sentence <br /> or provision of this Agreement. <br /> 19. Covenan# Runn�a with the l�nd. This Agreement �I be recorded by the City in <br /> the �nty Recar+der's Office of the Courrty a� San Mateo, Califiomla a# tl�e Property <br /> Owner's expense. The covenants and agreements oon#ained herein shal� be deemed to <br /> be covenants running with TiNe to the land for the benefit of the C'rty and tt�sucoessars. <br /> 20. �3elease of Aqreement. in the event that the City determines that the st�tmwater <br /> treatment measures located on the Property are no Iflnger required, then the City� at the <br /> request o# the Property Owner shall execute a release of this Agreement, whkh tfie <br /> Pro�r#y Owner shaH record in the County Recorder's Office at the Property Uwners <br /> expense. The City reserves the op#ion to record such release of this Agreement. The <br /> stormwater treatment measure(s) shall not be removed from the Property unless such a <br /> release is so executed and recorded. <br /> 21. Effective Date and Modification. This Agreement is effective upon the date of <br /> execution as stated at the beginning of this Agreement. This Agreement shail not be <br /> modif'�ed except by written instrument executed by the Ci#y and the Property Owner at <br /> the time of modification.
