Copies of the general prevailing rates of per diem wages for each craft, classification, or <br /> type of worker needed to execute the Contract, as determined by Director of the State of <br /> California Department of Industrial Relations, are on file at City's office and are deemed <br /> included in this contract. Contractor shall post the applicable prevailing wage rates at the job <br /> Site. The City has a web site (www.redwoodcity.org), which is linked to the Department of <br /> Industrial Relations,where Contractor may obtain prevailing wage data. <br /> If workers in any apprenticeable craft or trade, will be employed on the Project, <br /> Contractor shall submit contract award information containing the information requested in DAS <br /> form 140,to apply to the joint committees administering the apprenticeship standards of the craft <br /> or trade within the area of the Project, for a certificate approving Contractor under the <br /> apprenticeship standards for the employment and training of apprentices, in accordance with <br /> section 1777.5 of the California Labor Code and section 230 of Title .8 of the California Code of <br /> Regulations. Such notice shall be submitted within ten (10) days of the date of the execution of <br /> this Contract, but in no event later than the first day in which a worker is employed on the <br /> project. <br /> Contractor shall comply with the requirements in Labor Code Sections 1810 et seq <br /> concerning hours in a workday and week and overtime. <br /> Contractor shall comply with Labor Code Section 1776, regarding certified payroll <br /> records. <br /> 10. Documents. If applicable, Contractor shall deliver to the City, on request of the <br /> City Manager, copies of all original papers, documents and any other materials, in electronic or <br /> any other form,prepared by Contractor pursuant to this Agreement. <br /> 11. Licenses. If a license of any kind, which term is intended to include evidence of <br /> registration, is required of Contractor, its employees, agents or subcontractors by federal or state <br /> law, Contractor warrants that such license has been obtained, is valid and in good standing, and <br /> Contractor shall keep it in effect at all times during the term of this Agreement, and that any <br /> applicable bond has been posted in accordance with all applicable laws and regulations. <br /> 12. Time is of the Essence. Contractor agrees to diligently prosecute the services to <br /> be provided under this Agreement to completion and in accordance with the schedule specified <br /> in E�ibit A. In the performance of this agreement,time is of the essence. <br /> 13. Termination. This Agreement may be terminated or suspended by the City upon <br /> fifteen (15) days written notice. Upon receipt of such notice from the City, Contractor shall <br /> immediately stop all work under this Agreement. In the event of termination by the City, <br /> Contractor shall be entitled to payment on a pro rata basis for the services performed as of the <br /> date of termination,to the extent they were performed in accordance with this Agreement. <br /> 14. Severabilitv. If any term or portion of this Agreement is held to be invalid, <br /> illegal, or otherwise unenforceable by a court of competent jurisdiction,the remaining provisions <br /> of this Agreement shall continue in full force and effect. <br /> ATTY/AGR/2014.047/PROFESSIONAL PIPE SERVICES <br /> REV:04-10-14 VR <br /> Page 4 of 11 <br />
