7.1.F. - Page 6 <br /> RECORDING REQUESTED BY ) <br /> AND WHEN RECORDED MAIL TO: ) <br /> ) <br /> City of Redwood City ) <br /> 1017 Middlefield Road ) <br /> Redwood City, California 94063 ) <br /> Attention: City Clerk ) <br /> ) <br /> (Space Above This Line for Recorder's Use Only) <br /> Exempt from recording fee per Gov.Code§27383. <br /> IMPROVEMENT AGREEMENT <br /> (INDIGO, 525 Middlefield Road,Redwood City, CA) <br /> THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this <br /> day of , 2014 ("Effective Date") by and between DOWNTOWN RWC <br /> RES, LLC, a Delaware limited liability company ("Developer"), and the CITY OF REDWOOD <br /> CITY, a charter city and California municipal corporation ("City") with reference to the <br /> following facts: <br /> RECITALS <br /> A. Developer is the current fee owner of that certain real property consisting of <br /> approximately 2.44 acres located within the City of Redwood City, County of San Mateo, State of <br /> California,described in Exhibit A,attached hereto and incorporated herein by reference(the"Property"). <br /> B. On November 18, 2013, the City Council of the City of Redwood City adopted, among <br /> other approvals, Resolution No. 15305, approving the Vesting Tentative Map and Condominium Permit <br /> for the Indigo 525 Middlefield project("Project"),prepared by Sandis Civil Engineers and dated July 31, <br /> 2013 ("Tentative Map"), subject to certain conditions of approval set forth in Resolution No. 15305 <br /> ("Conditions"). <br /> C. The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled "Offsite <br /> Improvements 525 Middlefield Road", prepared by Sandis Engineers and dated April , 2014 (the <br /> "Improvement Plans"), which, in addition to other improvements, provide for certain on-site public <br /> improvements consisting of street and street light improvements, storm drain systems, domestic water <br /> systems and sanitary sewer systems for the Project(collectively,"Improvements"). <br /> F. Upon approval and recordation of the Final Map,the Property will be combined into one <br /> single lot for condominium purposes.
