7.1.F. - Page 77 <br /> owns any Residential Units, with the Association]. The Parking License Agreement may contain <br /> other provisions regarding the rights of access to and rights to park in the Garage and the <br /> obligations to pay the prorated Parking Charges for the use of such Parking Space. If any Person <br /> who has been provided a license or otherwise been assigned a right to park under this Section 2.4 <br /> fails to pay the Parking Charges allocated to that Person, the Declarant, as long as Declarant is <br /> operating the Garage, and the Association, after such time as such operational responsibilities for <br /> the Garage are undertaken by the Association, shall have the right to suspend such Person's <br /> rights of access to and rights to park in the Garage until all of such Residential Parking Charges, <br /> plus any late fees, interest and costs of collection have been paid in full. No Association or any <br /> Owner shall interfere with the rights of the Declarant hereunder or of any Person to which <br /> Declarant transfers such rights. <br /> G. Car Share Program: The Association may establish car share parking <br /> spaces in the Garage. The use of these car share parking spaces shall be reserved for a car <br /> share operator who is licensed under a contract with the Declarant or Association to make use of <br /> these car share parking spaces. The Association shall have the rights and power to enter into <br /> arrangements and adopt Rules for use of the car share parking spaces on such terms as the <br /> Association deems reasonable and appropriate. Access and use of these car share parking spaces <br /> shall be subject to the terms of the agreement between the Association and the car share <br /> operator. No Owners or Occupants shall use the car share parking spaces except in accordance <br /> with the agreement between the Association and the car share operator. As long as Declarant has <br /> the right of Parking Licenses under this Declaration, Declarant shall have the right to approve any <br /> such contract with the Association to make use of these car share parking spaces. <br /> H. Valet Parking Program: The Declarant, as long as Declarant owns a <br /> Residential Unit, and thereafter the Association, may establish valet parking program for parking <br /> vehicles in the Garage ("Valet Parking Program"), provided that such Valet Parking Program does <br /> not interfere with the use of the Garage by Owners who have been granted licenses for the use of <br /> Parking Spaces in the Garage. As long as Declarant has the right of granting Parking Licenses <br /> under this Declaration, Declarant shall have the right to approve any such Valet Parking Program <br /> established by the Association. <br /> Parking Restrictions: All parking of vehicles in the Garage shall conform to <br /> the provisions of Section 7.4 and the provisions of this Section 2.4. <br /> J. Handicap Parking Spaces: There are handicap parking spaces in the portion <br /> of the Garage of the Project designated and limited to parking by the Owners or Occupants of <br /> Residential Units. The Declarant may assign and license these Parking Spaces to Residential Units <br /> as Exclusive Use Common Area parking spaces. If the Occupants of the Residential Unit assigned <br /> a handicap space are not appropriately licensed to use a handicap parking space by the State of <br /> California and the Occupant of another Residential Unit assigned a parking space is appropriately <br /> licensed and the space assigned this Residential Unit for such Occupant is not a handicap parking <br /> space (the "Licensed Occupant"), the Association, on receipt of written request from the Licensed <br /> Occupant, shall require the Owner of a Residential Unit that has been assigned a handicap space <br /> that is not used by a Licensed Occupant to exchange the handicap space with the space assigned <br /> to the Residential Unit occupied by the Licensed Occupant. The exchange shall remain in effect <br /> as long as the Licensed Occupant occupies the Residential Unit and remains licensed to use a <br /> handicap space and shall terminate automatically on the date the Licensed Occupant ceases to <br /> occupy the Residential Unit or ceases to be appropriately licensed to use a handicap parking <br /> space, whichever occurs first. The exchange shall be temporary and shall not alter the permanent <br /> parking space(s) assigned to any Residential Unit and appurtenant to the Residential Unit. The <br /> Owners of the Residential Unit assigned the handicap spaces covenant to cooperate with the <br /> Association and any Licensed Occupant in effecting any exchange required under this Section 2.4. <br /> The right to exchange a non-handicap space for a handicap space hereunder shall be available to <br /> any Licensed Occupant on a first-come, first-serve basis as to the Parking Space that has been <br /> designated for such use. The Association shall have no obligation to create or establish any <br /> additional such handicap parking spaces.
