The Owners shall equally share in the costs and expenses for the repair, <br /> replacement, and maintenance of the Utility Facilities, except the Concrete Drainage Channel shall be <br /> shared equally by lots 3, 4, and 5, all as designated on the Map, and/or Exhibit B • The owners will bear <br /> the liability, in the same percentage as they share of the costs of repairs, replacement, and maintenance, <br /> for any personal injury or property damage to any worker employed or equipment used to perform repair, <br /> replacement or maintenance work to each utilities facility, or to any third person, provided the injury or <br /> damage results from or arises out of maintenance or repair work undertaken pursuant to this Agreement. <br /> E. During the course of construction and sale of the Project, the Declarant, at its <br /> sole cost and expense, shall implement the Mitigation Monitoring and Reporting Program ("MMRP") <br /> approved in association with the Project, a copy of which is attached hereto as Exhibit C, and made a part <br /> hereof. Thereafter,each Owner[or the Owners, in the case of work impacting more than one Lot], at his, <br /> her, or their sole cost and expense, shall implement the MMRP in relation to any activities undertaken by <br /> an Owner[or the Owners, in the case of work impacting more than one Lot]which are the subject of the <br /> MMRP. <br /> F. During the course of construction and sale of the Project, the Declarant, at its <br /> sole cost and expense, shall implement the Stormwater Treatment Measures Maintenance Agreement <br /> dated , 2014, and recorded on , 2014, as document <br /> number , official records of San Mateo County, California ("STMMA"). <br /> Thereafter, each Owner[or the Owners, in the case of work impacting more than one Lot], at his, her, or <br /> their sole cost and expense, shall implement the STMMA in relation to any activities undertaken by an <br /> Owner[or the Owners, in the case of work impacting more than one Lot]which are the subject of the <br /> STMMA. <br /> 3.2 Easements for Utilities and Maintenance: Easements over, under, in and through each <br /> Lot for the installation, repair and maintenance of the Easement, electric, telephone, water,gas and <br /> sanitary sewer lines and facilities, cable television lines, drainage facilities, walkways and landscaping, <br /> and as may be hereafter required or needed to service the Project, are hereby reserved by Declarant and <br /> its successors and assigns, until completion of construction of the Project and thereafter are reserved by <br /> and for the benefit of the Owners. Said easements shall be for the benefit of the Project.The foregoing <br /> easements are granted and reserved subject to the condition that their use and enjoyment shall not <br /> unreasonably interfere with the use, occupancy or enjoyment of all or any part of the Lot servient to them, <br /> or to which they are appurtenant. <br /> ARTICLE IV <br /> Use Restrictions <br /> In addition to all of the covenants contained herein, the use of each Lot is subject to the following: <br /> 4.1 Lot Use: No Lot shall be occupied and used except for residential purposes by the <br /> owners, their tenants and social guests. No tent, shack,trailer, basement, garage, outbuilding or structure <br /> of a temporary character shall be used at any time as a residence, either temporarily or permanently. A <br /> Lot may be used as a combined residence and executive or professional office by the owner thereof, so <br /> long as such use does not interfere with the quiet enjoyment of the Lots owned by the other Owners in the <br /> Project. <br /> 4.2 Nuisances: No noxious, illegal or seriously offensive activities shall be carried on upon <br /> any Lot, nor shall anything be done thereon which may be or may become a serious annoyance or a <br /> nuisance to or which may in any way interfere with the quiet enjoyment of an Owner's Lot. <br /> 4.3 Garbage and Refuse Disposal: All rubbish, trash and garbage shall be regularly removed <br /> from each Lot, and shall not be allowed to accumulate thereon. Trash, garbage and other waste shall not <br /> be kept except in sanitary containers. No toxic or hazardous material shall be disposed of within the <br /> Project by dumping in the garbage containers or down the drains,or otherwise.
