7.1.L. - Page 76 <br /> (iii) The location, if any, designated for posting of a general notice, pursuant to <br /> Civil Code section 4045(a)(3). <br /> (iv) Notice of a Member's option to receive general notices by individual delivery, <br /> pursuant to Civil Code section 4045(b). <br /> (v) Notice of a Member's right to receive copies of meeting minutes,pursuant to <br /> Civil Code section 4950(b). <br /> (vi) The statement of assessment collection policies required by Civil Code <br /> section 5730. <br /> (vii) A statement describing the Association's policies and practices in enforcing <br /> lien rights or other legal remedies for default in the payment of assessments. <br /> (viii) A statement describing the Association's discipline policy, if any, including <br /> any schedule of penalties for violations of the Governing Documents pursuant to Civil Code section 5850. <br /> (ix) A summary of dispute resolution procedures,pursuant to Civil Code sections <br /> 5920 and 5965. The summary required by Civil Code section 5965 shall include the following language: <br /> "Failure of a Member of the Association to comply with all <br /> the alternative dispute resolution requirements of Section <br /> 5930 of the Civil Code may result in the loss of the <br /> Member's right to sue the Association or another Member <br /> of the Association regarding enforcement of the Governing <br /> Documents or the applicable law." <br /> (x) A summary of any requirements for Association approval of a physical <br /> change to property, pursuant to Civil Code section 4765. <br /> (xi) The mailing address for overnight payment of assessments, pursuant to Civil <br /> Code section 5655. <br /> (xii) The annual policy statement shall include the notice required by Civil Code <br /> section 5730(a) in at least 12-point type. <br /> (xiii) Any other information that is required by law or the Governing Documents or <br /> that the Board determines to be appropriate for inclusion. <br /> 5.10.5 Transfer Documents. Copies of the transfer documents described in Civil Code <br /> section 4525 shall be provided to any Owner or any other recipient requested by Owner within ten days of the <br /> mailing or delivery of a written request. The transfer documents shall be provided and reasonable fees <br /> charged in accordance with the procedures, requirements and restrictions set forth in Civil Code section 4530. <br /> 5.11 Enforcement of Bonded Obligations. If the Association is the obligee under a bond or other <br /> arrangement("Bond")to secure performance of the commitment of the Declarant or a successor or assign to <br /> complete the Common Area Improvements not completed at the time the California Bureau of Real Estate <br /> issued a final subdivision report,the Board will consider and vote on the question of action by the Association <br /> to enforce the obligations under the Bond with respect to any Improvement for which a notice of completion <br /> has not been filed by the later of: (i)60 days after the completion date specified for that Improvement in the <br /> "planned construction statement" appended to the Bond; or (ii) 30 days after the expiration of any written <br /> extension given by the Association.
