7.1.L. - Page 89 <br /> 7.6 Enforcement. If any Owner or Occupant violates the provisions of this Article 7, the <br /> Declarant or the Association, in addition to levying monetary fines or penalties and in addition to any other <br /> remedy available at law or equity, may bring an action to compel compliance, including an action for a court <br /> order mandating the removal of any Improvement or other property constructed or installed in violation of the <br /> provisions of this Article 7. In such action, the prevailing party shall be entitled to recover costs and <br /> reasonable attorneys'fees. <br /> 7.7 Board's Authority. If for any reason the Committee is not established or not active,the Board <br /> shall perform the duties and shall have the rights of the Committee as described in this Article 7. <br /> Notwithstanding anything herein to the contrary, modifications, changes or additions to any Common Area <br /> Improvements authorized by the Board shall not require approval from the Committee. <br /> 7.8 Governmental Approval. Before commencement of any addition of any Improvement or any <br /> alteration to any Improvement approved by the Committee, the Owner shall comply with all the appropriate <br /> governmental laws and regulations. Approval by the Committee does not satisfy the appropriate approvals <br /> that may be required from any governmental entity with appropriate jurisdiction. <br /> 7.9 Declarant Exemption. Declarant, or its successor or assign, shall not be subject to the <br /> approval requirements of this Article 7 in connection with the construction or alteration of any Improvement <br /> within the Development or the installation of any landscaping, provided that this exemption shall expire on the <br /> third anniversary date of the recordation of this Declaration. In addition Declarant,or its successor or assign <br /> shall not be subject to the approval requirements of this Article 7 in connection with any repairs or <br /> modifications made to any Improvements as may be required by law or pursuant to an agreement with any <br /> Unit Owner or the Association. <br /> ARTICLE 8 <br /> Insurance <br /> 8.1 Owner's Insurance Requirements. Each Owner at all times shall procure and maintain the <br /> property,and liability insurance policies described in Section 8.1.1 and 8.1.2. The policies shall be obtained <br /> from insurance companies that have insurance ratings equal to or great than the ratings required under <br /> Section 8.4. If requested by the Board,the Owner shall provide the Board with appropriate certification that <br /> the insurance required under this Section 8.1 is in full force and effect. Notwithstanding the foregoing, <br /> nothing herein imposes any duty or obligation on the Association, its directors, officers or agents (including <br /> the manager)to confirm or otherwise verify that Owners have procured the required insurance. Furthermore, <br /> neither the Association nor any director, officer or agent (including the manager) shall have any liability <br /> whatsoever resulting from any loss to the Association or any Owners caused by an Owner's failure to procure <br /> the required insurance. <br /> Each Owner is advised to consult with a qualified insurance consultant regarding the Owner's <br /> insurance obligations under Sections 8.1.1 and 8.1.2. <br /> 8.1.1 Owner's Property Insurance. The property insurance maintained by the <br /> Association does not cover the Improvements within the Owner's Unit, including the residential <br /> structure. It is each Owner's responsibility to procure property insurance for the Improvements and <br /> personal property within the Owner's residence including the roof, siding, windows, structural <br /> components, interior walls, flooring, cabinets, countertops, built-in appliances and utility fixtures. <br /> Each Owner shall procure a property insurance policy that provides coverage against losses to the <br /> Improvements within the Owner's Unit including the residence,caused by fire and all other hazards normally <br /> covered under a "special form" policy or its equivalent in an amount not less than the full insurable <br /> replacement value of the Unit Improvements.
