This analysis will focus on measuring the <br /> cumulative economic, fiscal, and community benefit outcomes resulting from new <br /> incentive-oriented land use regulations in the City to show more explicitly who <br /> benefits and where the added development is likely to occur <br /> The proposed program will include: <br /> • Benefit priorities based by type and general location and the preferences <br /> expressed during the community engagement process; <br /> • Effective implementation strategies and procedural approaches; <br /> • General Plan and Zoning Ordinance amendments that may be necessary to <br /> implement the community benefits program; and <br /> • Requirements for additional economic analysis. <br /> Procedural alternatives may include: <br /> • Development tiers, reflecting development intensity, project type, project <br /> location; <br /> • Ministerial approaches( e.g. as-of-right benefits with no discretionary review) <br /> with prescribed benefits tied to specific bonuses; <br /> • Adjudicative (Conditional Use Permit) discretionary review, which would allow <br /> for reasonable conditions of approval; and <br /> • Negotiated legislative authorization (development agreement, planned <br /> development provisions, overlay districts, etc.). <br /> The proposed program also will contain mechanisms for monitoring compliance and <br /> outcomes. These may include periodic reviews to assess: <br /> • Whether benefits provided meet expectations; <br /> • Value of specific benefits in light of community needs, changes in regulatory <br /> environment, other factors; and <br /> • Effectiveness of administrative procedures and requirements. <br /> 4-B: Public-Private Defined Benefits Program Proposal for Adoption. Based on <br /> feedback from the community and decision-makers on evaluation of alternatives and <br /> the preliminary proposed program, Consultant will prepare a Final Public-Private <br /> Defined Benefits Program Proposal, which refines and details the components of a <br /> regulatory strategy for the City to consider if it enacts regulations for "capturing <br /> value" from new development to provide additional benefits to the community. The <br /> outcome of this phase of work will include a proposed draft enabling ordinance for <br /> the community benefits program, along with any needed General Plan amendments. <br /> The final program and supporting documents will include sufficient detail, so that <br /> Staff will be able to use it as a basis for refining the draft ordinance in consultation <br /> with the City Attorney and subsequently during the public review and adoption <br /> process.
