Conference with Legal Counsel - Initiation of Litigation Closed session regarding initiation of litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9 (13 Matters). Gov't. Code § 54956. 9(d) (4) provides that litigation is considered pending when "based on existing facts and circumstances, the legislative body of the local agency had decided to initiate or is deciding whether to initiate litigation ." B. Conference with Legal Counsel - Significant Exposure to Litigation Closed session regarding significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9 (One Matter). Gov't. Code § 54956.9(d)(2) provides that litigation is considered pending (or there is exposure to litigation) when "a point has reached where, in the opinion of the legislative body of the local agency on the advice of its legal counsel, based on existing facts and circumstances, there is significant litigation against the local agency." 5.
