Conference with Legal Counsel - Initiation of Litigation <br /> Closed session regarding initiation of litigation pursuant to paragraph (4) of <br /> subdivision (d) of Section 54956.9 (13 Matters). Gov't. Code § 54956. 9(d) <br /> (4) provides that litigation is considered pending when "based on existing <br /> facts and circumstances, the legislative body of the local agency had <br /> decided to initiate or is deciding whether to initiate litigation ." <br /> B. Conference with Legal Counsel - Significant Exposure to Litigation <br /> Closed session regarding significant exposure to litigation pursuant to <br /> paragraph (2) of subdivision (d) of Section 54956.9 (One Matter). Gov't. <br /> Code § 54956.9(d)(2) provides that litigation is considered pending (or <br /> there is exposure to litigation) when "a point has reached where, in the <br /> opinion of the legislative body of the local agency on the advice of its legal <br /> counsel, based on existing facts and circumstances, there is significant <br /> litigation against the local agency." <br /> 5.
