AGREEMENT FOR CONSTRUCTION SERVICES <br /> Contractor: EG Concrete Construction <br /> THIS AGREEMENT is made and entered into as of the 9 day of j r <br /> 2016, by and between the CITY OF REDWOOD CITY, a charter city and muniaf• al <br /> corporation of the State of California ("City"), and EG Concrete Construction <br /> ("Contractor") for work at Red Morton Park — concrete pathway ("Project"). <br /> RECITALS <br /> A. City requires the services of a concrete specialist to pour a 3,227 sq. ft. <br /> pathway at Red Morton Park (1400 Roosevelt Ave). Pursuant to Section 2.65 of the <br /> Redwood City Municipal Code, the City solicited written bids without public <br /> advertisement for this contract, as its estimated cost is greater than ten thousand dollars <br /> ($ 10,000), but less than one hundred thousand dollars ($100,000). <br /> B. Contractor has the necessary experience in providing such services and <br /> advice. <br /> C. Selection of Contractor is expected to achieve the desired results in an <br /> expedited fashion . <br /> D. Contractor has submitted a proposal to City and has affirmed its <br /> willingness and ability to perform such work. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein , the Parties agree as follows: <br /> 1 . Scope of Work. City retains Contractor to perform, and Contractor agrees to <br /> render, those services (the "Services") that are defined in attached Exhibit "A," which is <br /> incorporated herein by reference, including but not limited to removing broken concrete <br /> pathways and replacing walkway and driveway approach ramps with 4 inch baserock, <br /> installing #1 rebar on 18 inch centers and spacers, and adding 4 inch concrete at 3000 <br /> psi mix with broom finish , applying curing compound and returning the site to a clean <br /> condition . Contractor must provide, furnish, and supply all things necessary and <br /> incidental for the timely performance and completion of the Work, including all <br /> necessary labor, materials, equipment, transportation, temporary facilities, and utilities, <br /> unless otherwise specified herein . Contractor must use its best efforts to complete the <br /> Work in a professional and expeditious manner and to meet or exceed the performance <br /> standards required herein . In the event of a conflict between the provisions of Exhibit <br /> "A" and the terms of this Agreement, the terms of this Agreement shall prevail. City shall <br /> have the right to modify the scope of work to delete tasks in whole or in part. <br /> 1 . 1 Responsibility for the Work. Contractor is responsible for supervising and <br /> directing all aspects of the Work to facilitate the efficient and timely completion of the <br /> Work.
