Owner owns fee title to the approximately 1.1-acre site, commonly known as 849 <br /> Veterans Boulevard, in the City of Redwood City, County of San Mateo, State of California, <br /> designated as APN 052-386-060, legally described in Attachment l, which constitutes the <br /> entirety of the property that is subject to this Easement Agreement("Property"). <br /> B. City has approved Architectural Permit AP2015-89 to facilitate Owner's <br /> development and use of the Property with 90 for-rent apartment units, which approval includes a <br /> public pedestrian pathway through the Property as a community benefit, all as more specifically <br /> set forth in the Notice of Official Acfiion dated March 3, 2016("Project"). <br /> C. As contemplated by the application rnaterials for the Project submitted to City, <br /> City and Owner now desire that Owner grant to City an easement for use and enjoyment of the <br /> publicly accessible private open space by the general public and provide for the maintenance of <br /> such publicly accessible private open space, all as set forth below. <br /> EASEMENT AGREEMENT <br /> NOW THEREFORE, the parties agree as follows: <br /> l. Grant of Easement. For valuable consideration, Owner hereby grants and <br /> dedicates to the City a non-exclusive easement for use and enjoyment by the general public <br /> ("Easement") on, over and across that certain approximately 1,763 sq. ft. of real property <br /> located along the southeasterly property line of the Property, as legally described and depicted in <br /> Attachment 2 attached hereto and incorporated herein by reference ("Easement Area").
