11/07/2016 <br /> RESOLUTION NO. 15537 <br /> RESOLUTION OF NOTICE OF INTENT TO VACATE PUBLIC RIGHT-OF- <br /> WAY BEING A PORTION OF HANCOCK STREET, SPRUCE STREET, <br /> AND BUCKEYE STREET IN THE CITY OF REDWOOD CITY PURSUANT <br /> TO PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS <br /> CODE OF THE STATE OF CALIFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of <br /> Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ("City Council"), hereby declares its intention to vacate the public right-of- <br /> way being a portion of Hancock Street, Spruce Street, and Buckeye Street as shown on <br /> the Record of Survey Map No. 2383 in Volume 38 of LLS Maps, at Page 11, in the office <br /> of the Recorder for the County of San Mateo, attached hereto as Exhibit 1; and <br /> WHEREAS, because there are in-place utilities that are in use, vacation of the <br /> public right-of-way is subject to a reservation of a public utility easement and right to <br /> construct, maintain, operate, replace, remove, or renew public utility facilities, attached <br /> hereto as Exhibit 2, unless the City Council determines the public convenience and <br /> necessity require otherwise; and <br /> WHEREAS, because there is a need to provide continued access to the State of <br /> California right-of-way, vacation of the public right-of-way is subject to a reservation of a <br /> an access easement to provide for access, attached hereto as Exhibit 3, unless the City <br /> Council determines the public convenience and necessity require otherwise; and <br /> WHEREAS, because there is a need to provide for the collection and transmission <br /> of stormwater, vacation of the public right-of-way is subject to a reservation of a an <br /> stormwater easement to provide for collection and transmission of stormwater, attached <br /> hereto as Exhibit 4, unless the City Council determines the public convenience and <br /> necessity require otherwise; and <br /> WHEREAS, attached to Exhibit 5 (Public Hearing Notice) is a map or plan and <br /> legal description that shows the area intended to be vacated; and <br /> WHEREAS, pursuant to California Streets and Highways Code Sections 8322 and <br /> 8323, notice of intention to vacate the herein described public right-of-way shall be <br /> published and posted in substantially the form attached hereto as Exhibit 5; and <br /> WHEREAS, a noticed public hearing on the question of vacating the public utility <br /> easement, as described below, shall be held and evidence thereon received by the <br /> City Council on December 12, 2016; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> REDWOOD CITY AS FOLLOWS: <br /> ATTY/RESO.0103/CC RESO INTENT TO VACATE HANCOCK,SPRUCE,&BUCKEYE ST.
