11/28/2016 <br /> RESOLUTION NO. 15542 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY AMENDING THE DOWNTOWN PRECISE PLAN <br /> (Section 2.03 and 2.5.5) TO ADJUST LEVEL OF REVIEW <br /> AUTHORITY AND MAKE OTHER MINOR MODIFICATIONS (LEVEL <br /> OF REVIEW AUTHORITY AMENDMENTS) <br /> WHEREAS, these Level of Review Authority Amendments to the Downtown <br /> Precise Plan to amend the definition of "large project" to include any project over 35 ft. <br /> in height or 3 stories, and remove the Use Permit process requirements and refer to the <br /> Zoning Ordinance process; and <br /> WHEREAS , on October 18 , 2016 , the Planning Commission adopted a <br /> resolution recommending the proposed amendments with minor amendments; and <br /> WHEREAS, the minor amendments have been incorporated into this resolution <br /> recommended for City Council adoption ; and <br /> WHEREAS , a notice of public hearing on the Level of Review Authority <br /> Amendments was duly published in the Daily News at least 10 days prior to the public <br /> hearing ; and <br /> WHEREAS , at the public hearing , the City Council considered the whole of the <br /> record . <br /> NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS : <br /> Section 1 . The recitals set forth above are true and correct, and are hereby <br /> incorporated herein by this reference as if fully set forth in their entirety. <br /> Section 2. The City Council hereby finds that the proposed Level of Review <br /> Authority Amendments are in the public interest and consistent with the Redwood City <br /> General Plan . <br /> Section 3. These proposed Level of Review Authority amendments have been <br /> reviewed with respect to applicability of the California Environmental Quality Act <br /> ("CEQA") and the State CEQA Guidelines (California Code of Regulations, Title 14, <br /> Sections 15000 et seq .) . The project is exempt from CEQA as it can be seen with <br /> certainty that there is no impact on the environment. (See, e.g . , CEQA Guidelines <br /> § 15061 (b) (3) .) Pursuant to Guidelines section 15091 (e) , the documents and other <br /> materials that constitute the record of proceedings upon which the Planning <br /> Commission has based its decision are located in and may be obtained from , the Office <br /> of the City Clerk at 1017 Middlefield Road , Redwood City, California .
