03/13/2017 <br />RESOLUTION NO. 15569 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />VACATING A PUBLIC SERVICE EASEMENT LOCATED AT 1553 EL <br />CAMINO REAL IN THE CITY OF REDWOOD CITY PURSUANT TO PART <br />3 OF DIVISION 9 OF THE CALIFORNIA STREETS AND HIGHWAYS <br />CODE <br />WHEREAS, pursuant to California Streets and Highways Code Division 9, Part 3, <br />Chapter 4 (commencing at Section 8330), the City Council of the City of Redwood City <br />("City Council") is authorized to summarily vacate the public service easement located at <br />1553 EI Camino Real as shown on the Subdivision Map "One Maple Street Subdivision" <br />in Book 130 of Maps, at Pages 54, 55, and 56, in the office of the Recorder for the County <br />of San Mateo; and <br />WHEREAS, the public service easement to be vacated is described and depicted <br />in Exhibit A and Exhibit B, attached hereto and incorporated by reference; and <br />WHEREAS, because there are no in-place utilities that are in use, vacation of the <br />public service easement is not subject to any reservations or exceptions; and <br />WHEREAS, pursuant to Streets and Highways Code Section 8333, the easement <br />has not been used for the purpose for which it was dedicated or acquired for five <br />consecutive years immediately preceding the proposed vacation; the easement has also <br />been determined to be excess by the City and there are no other public facilities located <br />within the easement; and <br />WHEREAS, the public service easement is not useful as a non -motorized <br />transportation facility as it is partially located beneath an existing building. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2. The easement located in the Vacation Area described and depicted in <br />Exhibit A and Exhibit B is hereby ordered vacated. From and after the date this <br />resolution is recorded, the public service easement vacated shall no longer constitute a <br />public service easement. <br />3.
