Code § 27383. , <br />AMENDED AND RESTATED <br />STORMWATER TREATMENT MEASURES <br />MAINTENANCE AGREEMENT <br />[700, 720 and 740 Bay Road] <br />THIS AMENDED AND RESTATED STORMWATER TREATMENT I,E/�SURES <br />MAINTENA E AGREEMENT ("Agreement") is made and entered into h 3 v <br />20"Effective Date"), by and between the City of Redwood City ("City") and <br />BMR -Bay LP, a Delaware limited partnership ("Property Owner"). <br />RECITALS <br />A. Property Owner and City entered into that certain Stonnwater Treatment <br />Measure Maintenance Agreement dated August 14, 2015, and recorded August 19, 2015, <br />as Instrument Number 2015-087753, in the Official Records of the County of San Mateo <br />("Original Agreement"); and <br />B. Property Owner and City have agreed that the Original Agreement be <br />amended and restated to include additional stormwater treatment measures not included <br />in the Original Agreement; and <br />C. On November 19, 2015, the California Regional Water Quality Control <br />Board, San Francisco Bay Region, adopted Order R2-2015-0049, issuing Waste <br />Discharge Requirements and National Pollutant Discharge Elimination System Permit No. <br />CAS612008 (the "NPDES Permit"); and <br />D. Provision C.3. of the NPDES Permit, as it may be amended or reissued from <br />time to time, requires the permittee public agencies to provide minimum verification and <br />access assurances that all treatment measures shall be adequately operated and <br />maintained by entities responsible for the stormwater treatment measures; and <br />E. The Property Owner is the owner of real property commonly known as 700 <br />Bay Road, 720 Bay Road and 740 Bay Road, Redwood City, CA 94063 (the "Property"), <br />as more particularly described in Exhibit "A", attached hereto and incorporated herein by <br />this reference; and <br />F.
