Developer is the current fee owner of that certain real property situated in the City of <br /> Redwood City,County of San Mateo, State of California,known as the_Stanford in Redwood City <br /> Phase 1 site and described on Exhibit"A", attached hereto and incorporated by this reference as if fully <br /> set forth herein(the"Property"). <br /> B. On December 12, 2016, the City Council of the City of Redwood City adopted, among <br /> other approvals, Resolution No. 15551, approving the Tentative Map TM2016-002 for the Property, <br /> which is part of the Stanford in Redwood City Phase 1 Project ("Project"), prepared by BKF Engineers <br /> and dated July 8,2016 ("Tentative Map"),subject to certain conditions of approval("Conditions") <br /> C. The Conditions require that Developer enter into a Landscape Maintenance Agreement <br /> for all assigned landscape areas in public rights of way, easements, and/or on property in which the City <br /> holds an interest to be maintained. Maintenance items shall include, but are not limited to, maintaining <br /> street, sidewalk, and drainage improvements on the two privately owned, but publically accessible streets <br /> (Barron Avenue and Warrington Avenue), planting trees, shrubs, flowers, grass and all appurtenances <br /> including irrigation systems and pedestrian scale lighting. <br /> D. In connection with its development of the Property, the Developer submitted to the City <br /> Improvement Plans, which include, inter alia, landscaping plans for improvements along the Property <br /> frontage("Plans"),all of which Plans have been approved by the City. The Plans provide for installation <br /> of certain improvements contemplated by project: i.e. landscaping, pedestrian lighting, irrigation, private <br /> roads, pedestrian paths, open space areas, street trees, and sidewalk curb and gutter ("Improvements") <br /> within public rights of way, easements, and on property in which the City holds an interest to be <br /> maintained ("Maintenance Area") as the Improvements and Maintenance Area are more specifically <br /> shown on Exhibit"B"attached hereto and by this reference made a part hereof. <br /> REV:03-31-17 PR <br /> Page 1of13 <br /> ATTY/AGR.2017.066/Stanford-LMA <br />
