RESOLUTION NO. 12147 <br /> DES:djk 0"'/16/94 (050/37) <br /> o RIG I N A L 2/28/94 <br /> RES 0 L UTI 0 N N O. 12147 <br /> ---------- - - <br /> RESOLUTION SUSPENDING OPERATION OF SECTION 7.02(b) (3) <br /> OF SETTLEMENT AGREEMENT AND MASTER WATER SALES CONTRACT <br /> WITH THE CITY AND COUNTY OF SAN FRANCISCO FOR FISCAL <br /> YEAR 1993-1994; AND ALLOCATING RESIDUAL UNALLOCATED <br /> WATER UNDER SECTION 7.02(b) (1) FOR FISCAL YEARS <br /> 1994-1995 AND THEREAFTER <br /> WHEREAS, pursuant to water supply contract dated August 8 , <br /> 1984 by and between the City and County of San Francisco ( "San <br /> Francisco" ) and the City of Redwood City, which contract <br /> incorporates by reference the terms and conditions of that <br /> certain "Settlement Agreement and Master Water Supply Contract" <br /> (the "Master Agreemen t" ) between San Francisco and certain <br /> agencies in San Mateo, Santa Clara and Alameda Counties (the <br /> "Suburban Purchasers") , this City obtains its potable water <br /> supply from the San Francisco Water Department (" SFWD") Hetch <br /> Hetchy water system; and <br /> WHEREAS, the quantity so committed is referred to in the <br /> Master Agreement as the "Supply Assurance"; and <br /> WHEREAS, the Master Agreement did not fully allocate the <br /> Supply Assurance among the Suburban Purchaser, but provided that <br /> the amount of Supply Assurance not already allocated on the basis <br /> of historical usage as of 1984, may, after taking into account <br /> water used by the City of Hayward ( "Hayward" ) and the Estero <br /> Municipal Improvement District ("Estero") , be allocated by <br /> agreement among the Suburban Purchasers; and <br /> WHEREAS, in absence of such an overall agreement, Section <br /> 7.02(b) (3) of the Master Agreement provides for a periodic <br /> "---""-'-~'---'-"--'-"--~----"~""-"'~~-'-""---'"- -."'" -".-.-,,-..--.-------- <br />
