<br />0 RIG I N A L <br /> <br />FXS:mgl n~/25/93 (019/33) <br />/18/93R <br />6/14/93 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />11999 <br /> <br />---------- <br /> <br />RESOLUTION SUMMARILY VACATING A PUBLIC SERVICE <br />EASEMENT, APPROVING AND AUTHORIZING ACCEPTANCE OF GRANT <br />OF EASEMENT IN EXCHANGE THEREFOR, AUTHORIZING AND <br />DIRECTING EXECUTION OF EASEMENT GRANT DEED AND <br />QUITCLAIM DEED AND PROVIDING FOR RECORDATION THEREOF <br /> <br />(SEAPORT CENTRE UNIT III SUBDIVISION) <br /> <br />WHEREAS, pursuant to the provisions of Chapter 4 (commencing <br /> <br />with §8330), Part 3, Division 9 of the Streets and Highways Code <br /> <br />of the State of California, this Council may summarily vacate a <br /> <br />public service easement, if such easement has been superseded by <br /> <br />relocation <br /> <br />and <br /> <br />there <br /> <br />are <br /> <br />no <br /> <br />other <br /> <br />public <br /> <br />facilities <br /> <br />located <br /> <br />within said easement; and <br /> <br />WHEREAS, a public service easement previously granted to the <br /> <br />Ci ty by Metropolitan Life <br /> <br />Insurance <br /> <br />Company pursuant <br /> <br />to <br /> <br />that <br /> <br />certain <br /> <br />map <br /> <br />entitled, <br /> <br />"Seaport <br /> <br />Centre <br /> <br />Unit <br /> <br />III, <br /> <br />Being <br /> <br />a <br /> <br />Subdivision of Lot <br /> <br />II <br /> <br />as <br /> <br />Shown on That Certain Map Entitled <br /> <br />'Seaport Centre' <br /> <br />Recorded in Volume <br /> <br />112 <br /> <br />of Maps, <br /> <br />Pages <br /> <br />4-6", <br /> <br />recorded in Volume 117 of maps at pages 17-21 in the Official <br /> <br />Records of the County of San Mateo, California, shall no longer <br /> <br />be <br /> <br />required <br /> <br />for <br /> <br />public <br /> <br />uses <br /> <br />provided <br /> <br />that <br /> <br />said <br /> <br />easement <br /> <br />be <br /> <br />relocated; and <br /> <br />WHEREAS, <br /> <br />the <br /> <br />owner <br /> <br />of <br /> <br />record <br /> <br />of <br /> <br />the <br /> <br />property <br /> <br />affected <br /> <br />thereby <br /> <br />shall <br /> <br />simultaneously <br /> <br />convey <br /> <br />to <br /> <br />the <br /> <br />City <br /> <br />a <br /> <br />deed <br /> <br />of <br /> <br />easement over that certain property in the City of Redwood City, <br /> <br />County of San Mateo, <br /> <br />State of California, <br /> <br />in exchange for the <br /> <br />easement <br /> <br />to <br /> <br />be <br /> <br />vacated, <br /> <br />which <br /> <br />easements <br /> <br />are <br /> <br />described <br /> <br />and <br /> <br />depicted <br /> <br />on Exhibit <br /> <br />"A" <br /> <br />hereof, <br /> <br />attached <br /> <br />hereto <br /> <br />and <br /> <br />by <br /> <br />this <br /> <br />reference incorporated herein; and <br /> <br />.".".""""'--" ......,,--........ ,---..-"..."....----..."".. <br />
