05/09/2005 ORIGINAL RESOLUTION NO. 14642 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY MAKING, PURSUANT TO ARTICLE 27 OF THE CITY ZONING ORDINANCE, THE REQUIRED FINDINGS AND APPROVING AN EXTENSION OF TIME FOR TERMINATION OF A NONCONFORMING USE LOCATED AT 739 EL CAMINO REAL, REDWOOD CITY WHEREAS, Section 27.4 of the Redwood City Zoning Ordinance, as amended, (the "Ordinance ") provides that any use of real property existing on July 12,2000 that did not conform to the minimum proximity provisions of Article 27, but was operated and maintained in compliance with all previous regulations; shall be regarded as a nonconforming use that may be continued for five (5) years after July 12, 2000; and WHEREAS, Section 27.4 became effective on July 12, 2000; and WHEREAS, as of July 12, 2000, the business at 739 El Camino Real (now known as Secrets Adult Boutique) (the "Business ") was generally operated and maintained in compliance with all previous regulations and was allowed to continue for a period of five (5) years after July 12, 2000; and WHEREAS, the amortization period for the Business ends on July 12, 2005, and WHEREAS, Section 27.5 of the Ordinance requires the extension of time for the termination of certain nonconforming uses if specific findings can be made by the City Council; and WHEREAS, on April 1 and April 22, 2005, a representative of the Business submitted an application for an extension of time for termination of the nonconforming use at 739 El Camino Real (the "Property "); and WHEREAS, a representative of the Business has met with staff and discussed the Business, investments made into the Business and relocation efforts; and WHEREAS, on May 9, 2005, this City Council held a hearing related to the extension of time requested and considered oral and written testimony related to the request. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: Atty /Reso /Reso.1536 14642 050305 1 Muff # 301
