<br />ORIGINAL <br /> <br />AGREEMENT <br />FOR <br />POLICE FACILITY ROOF DRAINAGE RECONSTRUCTION <br /> <br />This Agreement, entered into this ~~day of &,~L~ <br /> <br />,1999, by <br /> <br />and among the City of Redwood City, California, a municipal corporation of the <br /> <br />State of California ("City"), S. J. Amoroso Construction Co., Inc. ("Contractor") <br /> <br />and leach Mounce Architects ("Architect"); <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the City and Architect's predecessor in interest (H. Wendell <br /> <br />Mounce, ALA. & Associates) entered into an agreement dated January 12, <br /> <br />1990, thereafter amended by first amendment dated July 23, 1990, and second <br /> <br />amendment dated April 30, 1991 (collectively, "Architect's Agreement"), which <br /> <br />was assigned to Architect; and <br /> <br />WHEREAS, pursuant to Architect's Agreement, Architect designed, <br /> <br />prepared plans, specifications, and other contract documents (collectively, the <br /> <br />"Contract Documents"), and rendered other services for the construction of City's <br /> <br />new police facility (the "Facility"); and <br /> <br />WHEREAS. City and Contractor entered into an agreement dated <br /> <br />October 1, 1991 (the "Construction Agreement"), which incorporated by <br /> <br />reference the Contract Documents, pursuant to which Contractor constructed the <br /> <br />Facility; and <br /> <br />WHEREAS, on or about May 17, 1993, City's City Council accepted the <br /> <br />Facility; and <br /> <br />Agmt.194 <br />flsh/shlRCICouncii <br />DES:rg <br />09/09/98; 02/08/99R; 03/01/99R <br /> <br />,.
