" run,' ""iII!'o~ SEWER & STORMWATER SYSTEMS MAINTENANCE AGREEMENT (TOYON WAY SUBDIVISION) COPy RECITALS THIS SEWER & STORMWATER SYSTEMS MAINTENANCE AGREEMENT ("Agreement") is made and entered into I OcldìJß/ì d-ro ,2005, by and between the City of Redwood City ("City") and Verne H. Brown, Sharon L. Brown, and Ronald L. Brown ("Owners"), Owners of real property described in this Agreement. A. The Owners are the Developers of Toyon Way Subdivision as described in Exhibit "A," and in the approved Improvement Plans for the Toyon Way Division, Redwood City, San Mateo County, California. Said Improvement Plans were approved by the City of Redwood City Community Development Services, Engineering and Construction Division on nC kk! L.t---. ~. :2.DOS. Said approved plans are incorporated herein as set forth in full. J B. Provision C.3. of the San Mateo Countywide NPDES Municipal Stormwater Permit (Order 99-059, CAS 0029921), "NPDES Permit," and as it may be amended or reissued, requires the permittee public agencies to provide minimum verification and access assurances that all storm drainage measures shall be adequately operated and maintained by entities responsible for the installation and storm drainage systems. C. Attached hereto as Exhibit "B", and incorporated herein by this reference, is a legible reduced-scale copy of the Site Plan or comparable document showing the sanitary sewer & stormwater systems that are to be located or to be constructed on the Property, hereinafter referred to as the "Site Plan". D. The City is the permittee public agency with jurisdiction over the Property. E. The Owners recognize that the sewer & stormwater systems more particularly described and shown on the Site Plan, of which full-scale plans and any amendments thereto are on file with the Engineering & Construction Division of the City of Redwood City must be maintained as indicated in this Agreement. F. The City and Owners agree that the health, safety and welfare of the citizens of the City require that the sewer & stormwater systems detailed in the Site Plan or comparable document be constructed and maintained on the Property. NOW, THEREFORE, in consideration of the benefit received by the Owners as a result of the City's approval of the Site Plan, the Owners hereby covenant and agree with the City as follows: 1. Storm Drain a. Pursuant to this Agreement, the Owners will operate and maintain a Concrete "V" ditch two and one-half (2-1/2) feet wide and subdrains across the rear of the lots; catch basin, drain pipes of various sizes, pipe stabilizers, storm drain manholes, and weir structures, used for the removal and diversion of surface water from the individual lots in the subdivision properties.
