<br />. r .'~ . <br />" run,' <br />""iII!'o~ <br /> <br />SEWER & STORMWATER SYSTEMS <br />MAINTENANCE AGREEMENT <br />(TOYON WAY SUBDIVISION) <br /> <br />COPy <br /> <br />RECITALS <br /> <br />THIS SEWER & STORMWATER SYSTEMS MAINTENANCE AGREEMENT <br />("Agreement") is made and entered into I OcldìJß/ì d-ro ,2005, by and between <br />the City of Redwood City ("City") and Verne H. Brown, Sharon L. Brown, and Ronald L. <br />Brown ("Owners"), Owners of real property described in this Agreement. <br /> <br />A. The Owners are the Developers of Toyon Way Subdivision as described in <br />Exhibit "A," and in the approved Improvement Plans for the Toyon Way Division, Redwood <br />City, San Mateo County, California. Said Improvement Plans were approved by the City of <br />Redwood City Community Development Services, Engineering and Construction Division <br />on nC kk! L.t---. ~. :2.DOS. Said approved plans are incorporated herein as set forth in full. <br />J <br />B. Provision C.3. of the San Mateo Countywide NPDES Municipal Stormwater <br />Permit (Order 99-059, CAS 0029921), "NPDES Permit," and as it may be amended or <br />reissued, requires the permittee public agencies to provide minimum verification and <br />access assurances that all storm drainage measures shall be adequately operated and <br />maintained by entities responsible for the installation and storm drainage systems. <br /> <br />C. Attached hereto as Exhibit "B", and incorporated herein by this reference, <br />is a legible reduced-scale copy of the Site Plan or comparable document showing the <br />sanitary sewer & stormwater systems that are to be located or to be constructed on the <br />Property, hereinafter referred to as the "Site Plan". <br /> <br />D. <br /> <br />The City is the permittee public agency with jurisdiction over the Property. <br /> <br />E. The Owners recognize that the sewer & stormwater systems more <br />particularly described and shown on the Site Plan, of which full-scale plans and any <br />amendments thereto are on file with the Engineering & Construction Division of the City of <br />Redwood City must be maintained as indicated in this Agreement. <br /> <br />F. The City and Owners agree that the health, safety and welfare of the citizens <br />of the City require that the sewer & stormwater systems detailed in the Site Plan or <br />comparable document be constructed and maintained on the Property. <br /> <br />NOW, THEREFORE, in consideration of the benefit received by the Owners as a <br />result of the City's approval of the Site Plan, the Owners hereby covenant and agree with <br />the City as follows: <br /> <br />1. <br /> <br />Storm Drain <br /> <br />a.
