<br />ORIGINAL <br /> <br />CUSTODIAL AGREEMENT <br /> <br />THIS AGREEMENT made thisíØI day of~ 20œ. by and between the City <br />of Redwood City, a charter city and municipal corporation of the State of California <br />("CITY") AND SEQUOIA HIGH SCHOOL ALUMNI ASSOCIATION ("CUSTODIAN") with <br />reference to the following facts: <br /> <br />A. City is the owner of the real property bounded by Jefferson, Broadway, <br />and Middlefield Roads, in the City of Redwood City, San Mateo County, California. <br /> <br />B. In excavation of said real property, City uncovered numerous artifacts <br />more particularly described in Exhibit A attached hereto and incorporated herein (the <br />"Property"). <br /> <br />C. Custodian is aware of the existence of such Property and desires to <br />publicly display such items for public viewing (in display cases managed by Custodian) <br />at the Sequoia High School Campus located at 1201 Brewster Avenue, Redwood City. <br /> <br />D. City is amenable to Custodian taking custody of the Property and placing <br />same on public display as set forth herein. <br /> <br />NOW, THEREFORE, City, by mutual agreement with Custodian, places in the <br />custody of Custodian the Property itemized in Exhibit A, under the following terms and <br />conditions: <br /> <br />Atty/Agr/2005.074 <br />110205 <br /> <br />a. <br /> <br />That the Property remain vested in City, and that Custodian will not permit <br />the removal of any part of the Property from the Sequoia High School <br />Campus without the prior written consent of City; <br /> <br />b. <br /> <br />Custodian will undertake not to damage any of the Property and agrees to <br />maintain it in as good condition as it now is, subject to ordinary wear and <br />tear; <br /> <br />c. <br /> <br />Custodian agrees not to attempt to sell or encumber the Property, or <br />otherwise interfere with the rights of City with respect to the Property; <br /> <br />d. <br /> <br />Custodian will inventory the Property on a regular basis and shall advise <br />City of any deficiencies in the Property as soon as they become known; <br /> <br />e. <br /> <br />In the event that there is any change in the circumstances of Custodian <br />which would bear on the continued custody of the Property or on the terms <br />and conditions of such custody contained in this Agreement, Custodian <br />shall immediately notify City.
