12/17/2018 <br />RESOLUTION NO. 15725 <br />A RESOLUTION OF THE CITY OF REDWOOD CITY, ESTABLISHING <br />AESTHETIC STANDARDS FOR WIRELESS FACILITIES IN THE PUBLIC <br />RIGHTS-OF-WAY, AS AUTHORIZED BY REDWOOD CITY MUNICIPAL <br />CODE CHAPTER 29, ARTICLE VIII <br />WHEREAS, Chapter 29, Article VIII of the City's Municipal Code governs the <br />permitting, installation, and regulation of wireless facilities in the City's public rights-of- <br />way ("ROW"); and <br />WHEREAS, Chapter 29, Article VIII, section 29.104(a)(3) provides that the City <br />Engineer may "[d]evelop and implement acceptable designs and development standards <br />for wireless facilities in the public rights-of-way, taking into account the zoning districts <br />bounding the public rights-of-way'; and <br />WHEREAS, the City's public rights-of-way are a uniquely valuable public resource, <br />closely linked with the City's character, making the regulation of wireless installations in <br />the public rights-of-way necessary to protect and preserve the aesthetics in the <br />community; and <br />WHEREAS, being authorized to do so, the City Engineer wishes to establish <br />aesthetic standards applicable to wireless installations in the public rights-of-way; and <br />WHEREAS, on December 17, 2018, the City Council conducted a duly noticed <br />public meeting and received testimony from City staff and all interested parties regarding <br />the aesthetic standards. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES RESOLVE AS FOLLOWS: <br />SECTION 1. The recitals above are each incorporated by reference and adopted <br />as findings of the City Council. <br />SECTION 2. The City hereby adopts Aesthetic Standards for wireless installations <br />in the public rights-of-way, which is attached hereto as "Exhibit A" and incorporated <br />herein by reference, contingent upon the City Council's adoption of, and effective upon <br />the effective date of, the ordinance to amend Redwood City Municipal Code Chapter 29 <br />to add Article VIII, "Wireless Facilities in Public Rights -of -Way." <br />SECTION 3. If any provision of this Resolution or its application to any person or <br />circumstance is held invalid, such invalidity has no effect on the other provisions or <br />applications of the Resolution that can be given effect without the invalid provision or <br />application, and to this extent, the provisions of this Resolution are severable.
