- 5/3/99 ~ <br /> 0RI6INAL <br /> <br /> RESOLUTION NO. 13616 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br /> OF AGREEMENT GRANTING ENCROACHMENT AGREEMENT <br /> FOR THE INSTALLATION OF FIBER OPTIC NETWORK <br /> FACILITIES WITHIN THE PUBLIC RIGHT-OF-WAY <br /> <br /> (RCN TELECOM SERVICES OF CALIFORNIA, INC.) <br /> <br /> WHEREAS, RCN Telecom Services of California, Inc., a California <br /> Corporation, wishes to install and maintain fiber optic network facilities within the <br /> public right of way within the limits of the City of Redwood City; and <br /> <br /> WHEREAS, under California law, the City of Redwood City may regulate <br /> the location and the manner of construction, installation, and maintenance of <br /> network facilities in the public right-of-way within the limits of the City of <br /> Redwood City; and <br /> <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br /> CITY, as follows: <br /> <br /> That certain permit agreement entitled "Encroachment Agreement <br /> between the City of Redwood City and RCN Telecom Services of California, <br /> Inc.," (form dated 04/20/99) by and between the City of Redwood City, a <br /> municipal corporation of the State of California and RCN Telecom Services of <br /> California Inc., granting authorization to RCN Telecom Services of California, <br /> Inc., to install, maintain, and repair fiber optic network facilities within the public <br /> right-of-way, a copy of which agreement is on file in the office of the City Clerk~ <br /> <br /> Reso-62.4 1 <br /> sh/rwc/council/reso <br /> fXS:fs <br /> 03/15/99 <br /> <br /> <br />
