- GROUND LEASE <br /> <br /> THIS GROUND LEASE (this "Lease"), made and entered into this 17th day of <br /> April ,2001, by and between the City of Redwood City, a municipal corporation of <br /> the State of California, hereinafter called "Lessor" or "City", and Shores Childcare, LLC, <br /> a California limited liability company, hereinafter called "Lessee," bears the following <br /> recitals: <br /> <br /> A. Lessor desires to enter into this Lease in order to accomplish the following public <br /> purposes: <br /> <br /> 1. Create a licensed childcare facility serving approximately 150 children in <br /> <br /> the Redwood Shores area of the City; <br /> <br /> 2. Cause the environmental and geotechnical contamination of the Leased <br /> <br /> Premises (as defined below) to be remediated; <br /> <br /> 3. Provide utilities to the Leased Premises; and <br /> 4. Provide a permanent access and utility easement in favor of the Leased <br /> <br /> Premises. <br /> <br /> B. Lessee is willing to undertake the accomplishment of the aforesaid public <br /> purposes on the teims and conditions hereafter set forth. <br /> <br /> NOW THEREFORE, Lessor and Lessee agree as follows: <br /> <br /> 1. LEASED PREMISES. Lessor (following due notice, hearing and award of <br /> <br /> this Lease to Lessee, all in accordance with the provisions of the Charter of the City of <br /> Redwood City), for and in consideration of the rental payments provided for herein and <br /> of the mutual agreements, terms, covenants and conditions herein contained, does hereby <br /> lease, let and demise to Lessee, and Lessee does hereby lease, hire and take from Lessor, <br /> all that certain real property of Lessor situated in the City of Redwood City, County of <br /> San Mateo, State of California, more particularly described in "Exhibit A," attached <br /> hereto, and by this reference incorporated herein together with any and all easements <br /> appurtenant thereto (collectively, the "Leased Premises" or "Premises").
