<br />ORIGINAL <br /> <br />RES 0 L UTI 0 N <br /> <br />!fQ.JII68 <br /> <br />OCT 1 6 18 <br /> <br />RESOLUTION URGING U.S. ARMY CORPS OF ENGINEERS TO APPROVE, AS SOON <br />AS PRACTICABLE, BROWNING-FERRIS INDUSTRIES' APPLICATION FOR A <br />SANITARY LANDFILL PERMIT AT APANOLIO CANYON <br /> <br />WHEREAS, the County of San Mateo and the cities within the County have <br /> <br />adopted a Solid Waste Management Plan which designates Ox Mountain as the <br /> <br />long term solid waste disposal site for the residents of San Mateo County; <br />and <br /> <br />WHEREAS, Ox Mountain has approximately thirty (30) months of permitted <br /> <br />capacity remaining; and <br /> <br />WHEREAS, the County of San Mateo has issued permits to Browning-Ferris <br />Industries for the use of Apanolio Canyon within Ox Mountain to accommodate <br />the long term needs for the County's solid waste management program; and <br />WHEREAS, it has been determined that Browning-Ferris Industries must <br />obtain a permit from the U.S. Army Corps of Engineers and, until recently the <br /> <br />Corps has been inclined to grant said permit; and <br /> <br />WHEREAS, the United States Environmental Protection Agency (EPA) has <br /> <br />recently contacted the Corps and advised the Corps that in the EPA's view the <br />Corps' anticipated approval of Browning-Ferris Industries' permit application <br />is prohibited under pertinent Federal regulatory provisions; and <br />WHEREAS, Browning-Ferris Industries and the County of San Mateo <br /> <br />strenuously disagree with EPA's conclusion and maintain that Browning-Ferris <br /> <br />Industries' permit application, including a mitigation plan, fully complies <br />with all applicable laws and regulations and should, therefore, be approved <br /> <br />by the Corps; and <br />WHEREAS, there appears to be no other reasonable long term alternative <br />for a sanitary landfill site available to the County of San Mateo and <br />
