ORIGINAL <br /> <br /> AGREEMENT <br /> <br /> PROFESSIONAL CONSULTING ENGINEERING AND DESIGN <br /> SERVICES - BAY TRAIL IMPROVEMENTS PROJECT AT THE <br /> TERMINUS OF WHIPPLE AVENUE <br /> <br /> THIS AGREEMENT, made and entered into this _~ day of <br /> , 2001, by and between the CITY OF REDWOOD CITY, a <br /> '\ <br /> <br />municipal corporation of the State of California, ("City"), and THE BEALS <br />GROUP, INC. of San Jose, California ("Consultant"); <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, City requires Bay Trail improvements at the terminus of <br />Whipple Avenue in the City of.Redwood City, California (the "Project"); and <br /> <br /> WHEREAS, in connection with the Project, the City requires professional <br />consulting engineering and design services; and <br /> <br /> WHEREAS, Consultant represents that it possesses the experience, and <br />is qualified to perform the aforesaid services for the Project; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. CONSULTANT'S SERVICES. Consultant shall perform consulting <br />engineering and design services described in Exhibit "A" hereof, attached hereto <br />and by this reference incorporated herein. <br /> <br /> 2. COMPENSATION; EXPENSES; PAYMENT. City shall compensate <br />Consultant for all services performed by Consultant hereunder in an amount <br />based upon Consultant's hourly rates that are prevailing during the time of the <br />performance of said services.
