'lQ~)3 <br /> <br />SANITARY SEWERAGE TREATMENT <br />CAPACITY RIGHTS AND SERVICES <br />(TOWN OF WOODSIDE) <br /> <br />THIS AGREEMENT, (hereinafter the "Agreement") made and entered into this <br />~ ~ d I L f'"Z.oO( <br />I day of -J ' .'O\A5'l ,,-00-, by and between the CITY OF REDWOOD CITY, <br />a municipal corporation of the State of California ("City"), and THE TOWN OF <br />WOODSIDE, a municipal corporation of the State of California ("Woodside"); and the <br />FAIR OAKS SEWER MAINTENANCE DISTRICT (the "District"). <br />WIT N E SSE T H: <br /> <br />WHEREAS, City and the District entered into that certain agreement dated July 23, <br />1985, (sometimes also described as the August 27, 1985, Agreement) entitled, "Agreement <br />- Sanitary Sewerage Treatment Capacity Rights and Services" (the "Basic Agreement"), <br />Exhibit "A" hereto, providing for transmission, treatment, and disposal of sewage <br /> <br />emanating from District's service area; and <br /> <br />WHEREAS, pursuant to Section (9) of the Basic Agreement, the services furnished <br />to District by City therein specified, and the Treatment Capacity Rights (as defined in the <br />Basic Agreement) reserved and conveyed to District thereunder are expressly limited to <br />sewage emanating from property situated within the service area of District described in <br />Exhibit "e" thereof and Exhibit "A" hereto; and <br />WHEREAS, Woodside has provided for the installation and construction of sewage <br />collection and transmission facilities for certain lands located within its corporate <br />boundaries; and <br />WHEREAS, the Town Center Sewer Assessment District (hereinafter called <br />"TCSAD") comprises a portion of the incorporated territory of Woodside and is more <br /> <br />RWCIWDSIFalr Oaks Agreement <br /> <br />1 <br />
