<br />DCB:sh 7/18/85 <br /> <br />JUL 22 1985 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9949 <br /> <br />OHIGJNAL <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />REVOCABLE ENCROACHMENT PERMIT FOR THE CONSTRUCTION OF <br />RETAINING WALLS ON CERTAIN CITY-OWNED REAL PROPERTY <br /> <br />WHEREAS, Design and Engineering Systems, Inc. has requested <br /> <br />permission to construct retaining walls on certain real property <br /> <br />described in Exhibit "A" attached hereto; and <br /> <br />WHEREAS, it is the intention and desire of this Council to <br /> <br />grant a revocable encroachment permit permitting construction of <br /> <br />retaining walls on said real property subject to certain <br /> <br />designated terms and conditions; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. That the City Manager is hereby authorized to execute a <br /> <br />revocable encroachment permit to Design and Engineering Systems, <br /> <br />Inc. which shall be transferrable or assignable to its heirs, <br /> <br />executors, administrators, assigns, beneficiaries, and successors <br /> <br />(of whatever nature), for the construction of retaining walls <br /> <br />upon that certain City-owned real property, more particularly <br /> <br />described in Exhibit "A" of that certain revocable encroachment <br /> <br />permit attached hereto and by this reference incorporated herein, <br /> <br />which permit shall not be effective until such time as Design and <br /> <br />Engineering Systems, Inc. or its assignee executes an acceptance <br /> <br />of its terms and conditions. <br /> <br />2. That the permit granted shall be in the form of that <br /> <br />certain permit entitled "Grant of Revocable Encroachment Permit <br /> <br />for <br /> <br />Construction <br /> <br />of <br /> <br />Retaining <br /> <br />Walls" <br /> <br />9949 <br />
