<br />DCB:sh 8/1/84 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9663 <br /> <br />ORIGl NAL <br />AUG 6 1984 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />REVOCABLE ENCROACHMENT PERMIT FOR CONSTRUCTION OF <br />PRIVATE LANDSCAPING ON CERTAIN CITY-OWNED REAL PROPERTY <br /> <br />WHEREAS, Belkin and Carcione Inc. (hereinafter "Owners") have <br /> <br />requested permission <br /> <br />to use <br /> <br />for construction of private <br /> <br />landscaping said real property described in "Exhibit A"; and <br /> <br />WHEREAS, it is the intention and desire of this Council to <br /> <br />grant a revocable encroachment permit permitting such private <br /> <br />landscaping uses subject to certain designated terms and <br /> <br />conditions; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. That the City Manager is hereby authorized to execute a <br /> <br />revocable <br /> <br />encroachment <br /> <br />permit <br /> <br />to <br /> <br />Owners <br /> <br />which <br /> <br />shall <br /> <br />be <br /> <br />transferrable <br /> <br />or <br /> <br />assignable <br /> <br />to <br /> <br />their <br /> <br />heirs, <br /> <br />executors, <br /> <br />administrators, <br /> <br />assigns, <br /> <br />beneficiaries, <br /> <br />and successors <br /> <br />(of <br /> <br />whatever nature), for construction of private landscaping upon <br /> <br />that <br /> <br />certain <br /> <br />City-owned <br /> <br />real <br /> <br />property, <br /> <br />more <br /> <br />particularly <br /> <br />described in "Exhibit A" of that certain revocable encroachment <br /> <br />permit attached hereto and by this reference incorporated herein, <br /> <br />which permit shall not be effective until such time as the Owners <br /> <br />execute an acceptance of its terms and conditions. <br /> <br />9663 <br />
